PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS OF CASS COUNTY, NORTH DAKOTA 5871 ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS AUGUST 15, 1979 Chairman Satrom called the meeting to order and upon roll call, all members were Mrs. Wold moved and Mrs. Stanton seconded that the minutes of the previous meeting be approved as written. Motion carried. In the absence of the County Road Superintendent, the Auditor reported that another letter was received from B. M. Mullen of Ayr, and the Auditor stated that he wrote a letter informing Mr. Mullen that his request for guard rails on a stretch along Highway 10 between Buffalo and Tower City is being investigated. Mr. Sondrall stated that he spoke to Mr. Grindberg concerning a request for gravel on County Road 34 from Arthur west 3 miles, and Mr. Grindberg stated that it will be graveled next week. Roger Fenstad from the Moore Engineering Company stated that there will be a dedication ceremony at 1:30 P.M. today on the County Road 31 bridge north of Fargo. Mr. Sondrall received a letter from Marlowe E. Toppen of Horace concerning the proposed bridge replacement over the Wild Rice River on State Highway 46. He state~ that he does not feel a new bridge is needed at this location. Mr. Sondrall stated that he and Mr. Hendrickson attended the public hearing which was held at Enderlin on July 10, 1979, but the Commission was not alerted to the situation previously, as Mr. Toppen stated. Mr. Sondrall intends to contact him regarding this letter. Upon the recommendation of the County Auditor, Mrs. Wold moved and Mr. Hendrickson seconded that the County accept the bid of the Dawson Insurance Company to furnish the County's insurance for a period of' three years. Motion carried on a roll call vote with all members voting "Aye". The States Attorney will be giving the Commission an opinion on whether the County needs to carry an Umbrella policy. Mr. Sondrall asked the Auditor to contact the Dawson Insurance Agency again on a window which was broken at the Gass'County Annex during a wind storm. Mr. Hendrickson moved and Mrs. Wold seconded that the Chairman be authorized to sign the contract with the Metropolitan Council of Governments for utilizing Federal funds for the County Planning Coordinator. ' The motion carried on a roll call vote with all members voting "Aye". Cynthia Rothe, States Attorney, gave her opinion on the gambling permit issued to the National Multiple Sclerosis Society-Northland Chapter. She stated that her only objection would be Paragraph 4 in the agreement between the Multiple Sclerosis Society and Melvin Blotsky, owner of the Watering Hole Bar at Wild Rice, which stated that Melvin Blotsky "shall have no responsibility for operating the gambling devices unless otherwise agreed upon between the parties from time to time". The Board instructed the States Attorney to write a letter to the Multiple Sclerosis Society to delete this paragraph from their agreement, and informing them that Multiple Sclerosis shall at all times be the sole operators of the gambling devices. Mrs. Wold moved and Mr. Hendrickson seconded that the following Monthly Reports for June and July be received and filed: The motion carried on a roll call vote with all members voting "Aye" Rush River Water Management District North Cass Water Management District Maple River Water Management District Southeast Cass Water Management District Cass County Veterans Service A delegation from the 12th Avenue North Neighborhood Association appeared before the Board and presented a report from the Army Corps of Engineers concerning a Notice of Application for Permit for the l2th-15th Avenue North river crossing. The report states that no controversy is anticipated and it states that the highway will be a principal arterial rather than a collector route as the Commission had thought. The delegation urged that the County Commission request a public hearing by the Corps of Engineers on this matter before any permits are issued. However, Mr. Hendrickson stated that he feels a request for a public hearing should be made in cooperation with the Fargo City Commission. Mrs. Wold moved and Mrs. Stanton seconded that the Cass County Commission contact the Mayor of Fargo asking if the City Commission wishes to join with the Cass County Commission in requesting the Corps of Engineers to hold a public hearing; but if the City does not wish to participate, the County will proceed on its own and request the public hearing. In discussion, Mr. Hendrickson felt that the County should meet with the City of Fargo before the County made the decision to call for a public hearing.
