<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />5871 <br /> <br />ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />AUGUST 15, 1979 <br /> <br />Chairman Satrom called the meeting to order and upon roll call, all members were <br /> <br />Mrs. Wold moved and Mrs. Stanton seconded that the minutes of the previous meeting <br />be approved as written. Motion carried. <br /> <br />In the absence of the County Road Superintendent, the Auditor reported that another <br />letter was received from B. M. Mullen of Ayr, and the Auditor stated that he wrote <br />a letter informing Mr. Mullen that his request for guard rails on a stretch along <br />Highway 10 between Buffalo and Tower City is being investigated. <br /> <br />Mr. Sondrall stated that he spoke to Mr. Grindberg concerning a request for gravel <br />on County Road 34 from Arthur west 3 miles, and Mr. Grindberg stated that it will be <br />graveled next week. <br /> <br />Roger Fenstad from the Moore Engineering Company stated that there will be a <br />dedication ceremony at 1:30 P.M. today on the County Road 31 bridge north of Fargo. <br /> <br />Mr. Sondrall received a letter from Marlowe E. Toppen of Horace concerning the <br />proposed bridge replacement over the Wild Rice River on State Highway 46. He state~ <br />that he does not feel a new bridge is needed at this location. Mr. Sondrall stated <br />that he and Mr. Hendrickson attended the public hearing which was held at Enderlin on <br />July 10, 1979, but the Commission was not alerted to the situation previously, <br />as Mr. Toppen stated. Mr. Sondrall intends to contact him regarding this letter. <br /> <br />Upon the recommendation of the County Auditor, Mrs. Wold moved and Mr. Hendrickson <br />seconded that the County accept the bid of the Dawson Insurance Company to furnish the <br />County's insurance for a period of' three years. Motion carried on a roll call vote with <br />all members voting "Aye". The States Attorney will be giving the Commission an opinion <br />on whether the County needs to carry an Umbrella policy. <br /> <br />Mr. Sondrall asked the Auditor to contact the Dawson Insurance Agency again <br />on a window which was broken at the Gass'County Annex during a wind storm. <br /> <br />Mr. Hendrickson moved and Mrs. Wold seconded that the Chairman be authorized to sign <br />the contract with the Metropolitan Council of Governments for utilizing Federal funds <br />for the County Planning Coordinator. ' The motion carried on a roll call vote with all <br />members voting "Aye". <br /> <br />Cynthia Rothe, States Attorney, gave her opinion on the gambling permit issued to <br />the National Multiple Sclerosis Society-Northland Chapter. She stated that her only <br />objection would be Paragraph 4 in the agreement between the Multiple Sclerosis Society <br />and Melvin Blotsky, owner of the Watering Hole Bar at Wild Rice, which stated that <br />Melvin Blotsky "shall have no responsibility for operating the gambling devices <br />unless otherwise agreed upon between the parties from time to time". The Board <br />instructed the States Attorney to write a letter to the Multiple Sclerosis Society <br />to delete this paragraph from their agreement, and informing them that Multiple Sclerosis <br />shall at all times be the sole operators of the gambling devices. <br /> <br />Mrs. Wold moved and Mr. Hendrickson seconded that the following Monthly Reports for <br />June and July be received and filed: The motion carried on a roll call vote with <br />all members voting "Aye" <br /> <br />Rush River Water Management District <br />North Cass Water Management District <br />Maple River Water Management District <br />Southeast Cass Water Management District <br />Cass County Veterans Service <br /> <br />A delegation from the 12th Avenue North Neighborhood Association appeared before the <br />Board and presented a report from the Army Corps of Engineers concerning a Notice of <br />Application for Permit for the l2th-15th Avenue North river crossing. The report states <br />that no controversy is anticipated and it states that the highway will be a <br />principal arterial rather than a collector route as the Commission had thought. <br />The delegation urged that the County Commission request a public hearing by the <br />Corps of Engineers on this matter before any permits are issued. However, Mr. Hendrickson <br />stated that he feels a request for a public hearing should be made in cooperation <br />with the Fargo City Commission. <br /> <br />Mrs. Wold moved and Mrs. Stanton seconded that the Cass County Commission contact <br />the Mayor of Fargo asking if the City Commission wishes to join with the Cass County <br />Commission in requesting the Corps of Engineers to hold a public hearing; but if the City <br />does not wish to participate, the County will proceed on its own and request the <br />public hearing.
