<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />5859 <br /> <br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />JUNE 5, 1979 <br /> <br />i <br />Chairman Satrom called the meeting to order and upon roll call, all members were present.! <br />I <br /> <br />Mrs. Stanton moved and Mrs. Wold seconded that the minutes of the previous meeting be <br />approved as written. Motion carried. <br /> <br />The Board convened as the County Board of Tax Equalization. <br /> <br />The first order of business was the equalization of cities. Clarence Miller, County <br />'Director of Tax Equalization, explained the freeze on assessments made by the State Board of <br />Equalization whereby the State Board requested that local assessors and boards of equalization <br />;proceed as in the past but that they not allow an overall total increase in any class of ' <br />property with the exception of new construction. Mr. Miller also explained his recommendatio~ <br />.for a 10% level of assessments rather than the 16% as in the past, and updating the market <br />:values to a more realistic figure. <br /> <br />Mr. Miller stated that the City of Casselton did not follow the 10% level of assessments, <br />,but he recommended that they be allowed to use the 16% this year providing they work 'it out " <br />'next year, and the City of Casselton has passed a resolution that the property be reassessed <br />for 1980 at the 10% level. <br /> <br />Upon the recommendation of Mr. Miller, Mrs. Stanton moved and Mrs. Wold seconded that <br />the County order a reassessment for the City of Gardner. Motion carried. <br /> <br />Upon the recommendation of Mr. Miller, Mrs. Wold moved and Mr. Hendrickson seconded that <br />the market values for the cities of Buffalo and Tower City be updated and that 10% be used as <br />the level of assessments. Motion carried. <br /> <br />Upon the recommendation of Mr. Miller, Mrs. Stanton moved and Mrs. Wold seconded that <br />the assessments ~n the C~ty of Front~er and the City of Briarwood be increased by 9% for 1979 <br />to bring them to the previous assessment. Motion carried. <br /> <br />Upon the recommendation of Mr. Miller, Mr. Hendrickson moved and Mrs. Stanton seconded <br />that the valuation of the lots in Prairie 'View Estates Addition to the City of Mapleton be <br />establ~shed at $3,000 per lot and a 10% level of assessments. Motion carried. <br /> <br />Mr. Sondrall moved and Mrs. Stanton seconded that the following resolution be adopted: <br />,Motion carried. <br /> <br />WHEREAS, the governing body of the County of Cass has determined that it would be in the <br />interest of the taxpayers owning real property in the County to have an annual assessment, <br />and <br /> <br />WHEREAS, Chapter 512, session laws of 1977 codified as subsection 6 of section 57-02-11 <br />of the North Dakota Century Code provides that the governing body of any county may, by re- <br />solution, provide for an annual assessment. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the governing body of the County of Cass, duly <br />assembled, does hereby determine that said county shall have the real property located within <br />the boundaries of the county valued and assessed each year based upon its value as of <br />February 1, 1980, and each succeeding year thereafter unless the governing body of the county: <br />,shall determine otherwise. <br /> <br />The next order of business was the equalization of townships. Mr. Miller read a letter <br />from Mr. Erhardt Krabbenhoft requesting a tax reduction because of spring flooding on his <br />land in the N\ of Section 1, Normanna Township. Mr. Miller stated that he answered the letter <br />informing him of the tax abatement procedure which goes through the local township board and ' <br />then the County board. <br /> <br />Mr. Miller <br />of assessments. <br />County be valued <br />estimated market <br /> <br />stated that several townships did not comply with the recommended 10% level <br />Mr. Hendrickson moved and Mrs. Stanton seconded that all property in Cass <br />at a realistic estimated market value and that 10% be applied against the <br />value to obtain the assessed value for 1979. Motion carried. <br /> <br />Mr. Don McIntyre appeared before the Board of Equalization to protest an added assess- <br />ment against the McIntyre-Pyle Seeds, Inc. located in Casselton Township. He stated that the <br />corporation itself does not own any property but was set up in order to establish a market <br />for their farm produce. Mr. Satrom stated that there are similar types of property in other <br />townships in the County which are not being assessed. The Board asked Mr. Satrom to report <br />these similar cases to Mr. Miller to see if they are being taxed at this time. <br /> <br />Mrs. Stanton moved and Mrs. Wold seconded that the County Board of Equalization be ad- <br />journed for 1979.
