<br />Commission Minutes--May 20, 2002 2448 <br /> <br />MOTION, passed <br />,.,--, Mr. Wagner moved and Mr. Meyer seconded to authorize the auditor to <br />consign two Dodge Spirits, owned by Cass County government, to the <br />Government Surplus Auction (GSA), and to purchase two other vehicles <br />from another auction for the motor pool with county motor pool funds; <br />and to amend the motor pool budget accordingly. On roll call vote, the <br />motion carried unanimously. <br /> <br />18. RESOLUTION #2002-7, MIDA Bonds for Shanley Hiah School Proiect <br />Mr. Meyer asked to move this item to the regular agenda and requested that the board <br />delay action on issuing MIDA Bonds for the Shanley High School Project because of some <br />concerns with the school administration. He said he could not be specific in order to protect <br />someone else's right to privacy. <br /> <br />Attorney Jim Stewart, of Arntson & Stewart, P.C., was present on behalf of Jon Arntson, <br />who is the bond counsel for this project. Mr. Stewart said the county's involvement is from a <br />financial perspective, in terms of being included in Cass County's annual $10 million bond <br />limit, and he is not aware of any statute authorizing the county to operate the business of <br />the project. <br /> <br />Mrs. Schneider was concerned about what effect the delay would have on the project, and <br />Lisa McEvers, Assistant State's Attorney who was present representing Birch Burdick, <br />State's Attorney, said she is aware of some notice requirements in the statutes. However, <br />,-- since she is not a regular attendee at Commission meetings, she could not give a definitive <br />answer today but would need more time to review and answer the question. <br /> <br />Mr. Stewart said the statutory notification requirements do not have any expiration under <br />State law but there is a one-year expiration date under Federal law. He said Cass County <br />government issued $4.5 million in MIDA Bonds for this project sometime last year, and <br />today's request is for the remaining $3.5 million on the project. <br /> <br />Mr. Wagner said he does not see where policy decisions of the school should preclude the <br />county from approving the MIDA Bond issue. He said he has not heard of any concerns <br />from the community about the project. <br />MOTION, passed <br />Mrs. Schneider moved and Mr. Wagner seconded to adopt Resolution <br />#2002-7 Authorizing the Issuance of School Facility Revenue Bonds <br />(Shanley High School Project) Series 2002, and approving and <br />Authorizing the Execution and Delivery of the Lease Agreement, the <br />Mortgage, and Other Documents. On roll call vote, the motion carried <br />with four members voting "Aye" and Mr. Meyer opposing. <br /> <br />19. <br /> <br />VOUCHERS, Approved <br />MOTION, passed <br />Mrs. Schneider moved and Mr. Wagner seconded to approve Voucher <br />No. 163,670 through No. 164,294. On roll call vote, the motion carried <br />unanimously. <br /> <br />,-- <br />
