WARRANTY DEED Page 2 Together with an easement with all others having a like right for the purpose of ingress and egress over and through a tract or parcel of land described as follows: that part of the North Half of the Southwest Quarter of the Northwest Quarter and that part of Government Lot 2, of Section 36, Township 142 North, Range 49 West, Cass County, North Dakota, described as follows, to wit: Commencing at a point on the West Section line of said Section 36, which point is 20.0 feet North of the Southwest corner of the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of said Section 36; thence South along the West Section line of said Section 36 for a distance of 20.0 feet to the Southwest corner of the Northwest Quarter of the Southwest Quarter of the Northwest Quarter of said Section 36; thence East along a line parallel with the South boundary of the Northwest Quarter of said Section 36 for a distance of 1,920.0 feet; thence N 450 E to a point which is 20.0 feet North of the extended North boundary line of the South Half of the Southwest Quarter of the Northwest Quarter of said Section 36; thence West along a line parallel with the South boundary of the said Northwest Quarter of said Section 36 and which line is parallel to and 20.0 feet North of the South boundary of the herein described tract or parcel, for a distance of 1,940.0 feet, more or less, to the point of beginning, said Easement being appurtenant to the above-described Auditor's Lot 2 and also being appurtenant to Auditor's Lot 1 of the North Half of Section 36, in Township 142 North, Range 49 West, Cass County, North Dakota; Excepting and reserving unto the Grantor, the right to convey said Easement or rights of ingress and egress under said Easement to the titleholders of said Auditor's Lot 1. THIS WARRANTY DEED IS BEING GIVEN, EXECUTED AND RECORDED TO CORRECT TITLE AND RETURN EXCESS LAND CONVEYED BY GRANTEES TO GRANTOR IN WARRANTY DEED DATED NOVEMBER 11, 1997 AND RECORDED NOVEMBER 12, 1997 AS DOCUMENT NO. 886409. Grantee certifies the transaction to be exempt from filing a statement of consideration under Section 11-18-02.2(e) of North Dakota Century Code.
