WARRANTY DEED <br /> <br /> THIS INDENTURE, Made this day of May 2002, between CASS COUNTY NORTH <br />DAKOTA, a Public corporation under the laws of the State of North Dakota, Grantor, and <br />VAUGHN JOHNSON AND SHIRLEY JOHNSON, husband and wife, as ioint tenants, of 2351 <br />173~ Avenue SE, Argusville, ND 58005, Grantees. <br /> <br /> WITNESSETH, For and in consideration of the sum of One Dollar and Other good and <br />Valuable Consideration, Grantor does hereby GRANT to the Grantee, ali of the following real <br />property lying and being in the County of Cass, and State of North Dakota, and described as <br />follows, to-wit: <br /> <br />Auditor's Lot 2 in the North Half of Section 36, Township 142 North, Range 49 <br />West of the 5th Principal Meridian, Cass County, North Dakota, except the <br />following part thereof: <br /> <br />From the Northwest comer of fractional Section 36, Township 142 <br />North, Range 49 West of the Fifth Principal Meridian, Cass County, <br />North Dakota, bear South 00°00'00'' West along the West Fine of <br />said Section 36 a distance of 2,004.52 feet; thence bear North <br />89038'49'' East a distance of 1,920.00 feet to the West corner of <br />Auditor's Lot No. 2 of a part of the North Half of said Section 36; <br />thence bear South 79000'25'' East along a portion of the boundary <br />line of said Auditor's Lot No. 2 a distance of 393.12 feet; thence <br />bear South 83028'44'' East a distance of 320.33 feet; thence bear <br />North 89038'57'' East a distance of 25.00 feet to the point of <br />beginning of the tract of land herein described; <br /> <br />thence South 00o15'51'' East a distance of 104.00 feet; thence <br />North 89°38'57'' East a distance of 30.00 feet; thence South <br />00°15'51'' East a distance of 80.00 feet; thence North 89038'57" <br />East a distance of 378 feet, more or less, to a point of intersection <br />with the westerly bank (left bank) of the Red River of the North; <br />thence northerly along said westerly (left) river bank to a point of <br />intersection with a line which bears South 89°38'57'' West and <br />intersects the point of beginning; thence South 89°38'57" West <br />along the last described intersecting line a distance of 405 feet, <br />more or less, to the point of beginning. Said tract of land contains <br />1.45 acres, more or less. <br /> <br />SUGGESTED MOTION: <br />Move to authorize the chairman and the county auditor to sign a warranty deed with Vaughn <br />and Shidey Johnson of Argusville, North Dakota, to reconvey excess property in Wiser <br />Township, which they deeded to Cass County in November, 1997, under the flood buy-out <br />program. <br /> <br /> <br />
