COUNTY DEED <br /> <br />This indenture made this 7th day of January, 2002, between the County of Cass, North <br />Dakota, party of the first part, and City of Leonard, PO Box 307, Leonard ND 58052, <br />party of the second part, witnesseth: ~ <br /> <br />WHEREAS, the real property hereinafter described was acquired by the county through <br />tax deed proceedings for the nonpayment of taxes levied and extended against said <br />property for the years 1996 to 2000 inclusive, with interest and penalties, amounting to <br />the sum of Three hundred fourteen and 28/100 ($314.28) dollars; WHEREAS, said real <br />property was offered for sale, and sold, pursuant to authority to law, on the 7th day of <br />January, 2002, and at said sale, said second party became the purchaser of the whole <br />thereof, for the sum of One and no/100 ($1.00) dollars, which has been paid in full; <br /> <br />NOW, THEREFORE, the said county as party of the first part, in consideration of the <br />premises, and pursuant to authority of law, hereby assigns, that certain real property <br />situated in Cass County, North Dakota, described as follows, to wit: <br /> <br />Commence Five hundred Sixty-four feet South (564') of Northeast corner of Southeast quarter (SE 1/4), <br />South One thousand Twenty feet (1020') Northwest One thousand Two hundred and Fifty feet (1250') <br />parallel with extended line of B Street then East Six hundred Forty-seven and Six tenths feet (647.6') to <br />beginning, less the following: Begin One thousand Two hundred and Nineteen feet South (1219') of <br />Northeast corner of Southeast quarter (SE 1/4) thence South Three hundred Sixty-five feet (365') thence <br />Northwesterly Four hundred Forty-seven and Three tenths feet (447.3') parallel with extended line of B <br />Street, thence East Two hundred Thirty-one and Fifty-two hundredths feet (231.52') to beginning, Section <br />Twenty-eight (28), Township One hundred Thirty-seven (137), Range Fifty-two (52), Unplatted land, City <br />of Leonard formerly know as Village of Leonard according to plat on file in the office of the Register of <br />Deeds, Cass County; less a tract of land in the Southeast quarter (SE 1/4) of Section Twenty-eight (28), <br />Township One hundred Thirty-seven (137), Range Fifty-two (52) West of the 5th P.M., Cass County, <br />North Dakota, described as follows: Commencing at the Northeast corner of said SE 1/4; thence South <br />along the Section line for a distance of One thousand Five hundred Eighty-four feet (1584 ), thenc <br />Northwesterly along a line parallel with the extended line of B Street in the City of Leonard, North Dakota, <br />for a distance of One thousand One hundred Thirty-feet (1130') to the point of beginning; thence continue <br />along said line paratlet to the extended line of B Street for a distance of Sixty feet (60'); thence deflect 90 <br />degrees 00 minutes for a distance of Eighty-three and Eighty-two hundredths feet (83.82'); thence deflect <br />to the right 35 degrees 35 minutes 42 seconds for a distance of Thirty-seven and Twelve hundredths feet <br />(37.12'); thence deflect to the right 54 degrees 24 minutes 18 seconds for a distance of Thirty-eight and <br />Thirty-nine hundredths feet (38.39'); thence deflect to the right 90 degrees 00 minutes for a distance of <br />One hundred Fourteen feet (114') to the point of beginning. Said tract contains .142 acres more or less <br />and less Auditor's Lot 3 of the SE 1/4 containing .63 acres and less Auditor's Lot 4 containing .65 acres. <br /> <br />Tax Parcel: 17-0400-13681-000 <br /> <br />To have and to hold the above described real property with all of the appurtenances <br />thereunto belonging to the said party of the second part, City of Leonard, heirs and <br />assigns forever. <br /> <br /> <br />
