<br />8. <br /> <br />"""' <br /> <br />9. <br /> <br />-- <br /> <br />,- <br /> <br />Commission Minutes--November 19, 2001 2383 <br /> <br />RESOLUTION #2001-25, 26, AND 27, Street Imorovement District #2001-1 bond aooroval <br />Attorney Dan Twichell presented documents for Commission approval concerning the bond <br />issue for Street Improvement District #2001-1 (Holmen's Third Subdivision). <br />MOTION, passed <br />Mr. Wieland moved and Mr. Wagner seconded to adopt resolutions <br />regarding $85,000 Refunding Improvement Bonds for Street <br />Improvement District #2001-1 (Holmen's Third Subdivision> as <br />follows: Resolution #2001-25 Approving Certain Actions and <br />Awarding Sale of Bonds; Resolution #2001-26 Creating the Funds of <br />Improvement Districts, Providing for and Appropriating Special <br />Assessments for the Support and Maintenance of Said Funds, and <br />Authorizing the Issuance of Improvement Warrants Thereon; and <br />Resolution #2001-27 Authorizing the Issuance of Bonds. On roll call <br />vote, the motion carried unanimously. <br /> <br />SHERIFF'S DEPARTMENT, Law Enforcement software aareement with City of Farao <br />Glenn Ellingsberg, Sheriffs Department, submitted a proposed agreement for the Board's <br />consideration which would allow them to share the City of Fargo's software for day-to-day <br />operations. The benefit is having a single data base where information is stored. He said no <br />cost is associated with this agreement today, however, additional agreements will be brought <br />to the Board at a later date with actual dollar amounts. <br /> <br />The County budgeted $10,000 for integration with the Fargo system in this year's budget, which <br />should pay for most of the transition to their software and the combining of data bases. It was <br />suggested by Mr. Ellingsberg that any additional cost for maintenance and upkeep be negotiated <br />and added to the annual 9-1-1 contract. Mr. Meyer said this is a good first step in cooperation <br />with the joint dispatch center. Mr. Wagner said Fargo's software is an exceptional and <br />expensive program and will allow for one system instead of two. He said it will be of great <br />benefit to the County. <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wagner seconded that the Sheriff's <br />Department be allowed to enter into an agreement with the City of <br />Fargo for law enforcement software. On roll call vote, the motion <br />carried unanimously. <br /> <br />10. <br /> <br />ROAD DEPARTMENT, Maole River Townshio access aareement in Section 13 <br />Keith Berndt, County Engineer, provided background information and a suggested solution to <br />the access problem in Section 13, Maple River Township, concerning farmland owned by David <br />Ratchenski. A proposed agreement was reached after a meeting involving Mr. Ratchenski; his <br />attorney, John Irby; Eugene Piper, owner of adjacent farmland; State's Attorney Birch Burdick; <br />Commissioner Robyn Sorum and Mr. Berndt whereby Mr. Ratchenski would sell his 32.2 acres <br />for $38,700 plus legal fees and other expenses. Mr. Piper would purchase the property for <br />$23,700, with Cass County paying the difference of $15,000 plus Mr. Ratchenski's legal and <br />other expenses, estimated at $4,000. It would have cost the county $15,000 if they were to <br />install a low-water crossing at this location to provide access for Mr. Ratchenski, according to <br />a recent estimate from Moore Engineering. Mr. Berndt said he thinks this is a good resolution <br />to the matter. <br /> <br />Mr. Wagner asked if this is a unique situation given the large number of bridges and culverts <br />throughout the county, and he expressed concern about this property if it changes ownership <br />
