<br />IT IS FURTHER AGREED, that party of the first part shall provide property and casualty <br /> <br />insurance on the building. City and County will provide any insurance coverage deemed necessary <br />on the personal property located on the subject property. As additional consideration of the rental <br /> <br />of the property in addition to the consideration hereinafter recited, Lessor recognizes that it <br />receives additional consideration by reason of the location and hook-up of the generator in the <br /> <br />provision of additional electrical power for its elevator, as well as other uses. <br /> <br />AND IT IS FURTHER AGREED, By and between the parties, as follows: <br /> <br />A. City/County will own and maintain the generator, provide any necessary <br />fuel and the like. In consideration of this lease, the generator remains the <br />property of HRA after termination of this agreement provided, however, <br />that HRA is not responsible for replacing the generator should the same <br />become destroyed, damaged, or rendered obsolete. <br /> <br />B. City/County agree that HRA shall not be liable for any failure of the <br />generator or the communications equipment thereby causing injury or <br />death to any person. N onliability for such shall not exonerate HRA from <br />liability resulting from its own negligence or intentional tort. <br /> <br />C. City/County will be allowed to utilize the building addition or new <br />building to be constructed on the roof of the High Rise. The building shall <br />be utilized for radio and communication equipment and related facilities, <br />thus providing additional equipment and facilities for emergency <br />management communication for local law enforcement and public safety. <br />In the event of termination, all equipment and related facilities shall be and <br />remain the property ofthe City /County. <br /> <br />D. City/County will pay for all equipment and costs of installation relating to <br />the building and its contents. <br /> <br />AND IT IS FURTHER AGREED that the said party of the second part also covenants and <br /> <br />agrees to and with the said party of the first part, not to sub-let the above-rented premises or any <br />part thereof, during the full term of this Lease, without obtaining the consent of the said party of the <br />first part, its successors or assigns, thereto, and that party of the second part will at the expiration of <br />the time herein recited, quietly yield and surrender the aforesaid rented premises to the said party of <br /> <br />2 <br />
