<br />LEASE AGREEMENT <br /> <br />THIS AGREEMENT, Made and entered into this _ day of <br /> <br />,2005, by and <br /> <br />between THE HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF <br /> <br />FARGO, hereinafter referred to as "HRA" or "Lessor", party ofthe first part, and THE CITY OF <br />FARGO, NORTH DAKOTA, a municipal corporation, and CASS COUNTY, NORTH <br /> <br />DAKOTA, a Home Rule county under North Dakota law, hereinafter referred to as "City", <br /> <br />"County", party ofthe second part, or "Lessee". <br /> <br />WITNESSETH, That the said party of the first part, for and in consideration of the rents <br />and covenants hereinafter mentioned, and to be paid and performed by the said party of the second <br /> <br />part, the said party of the first part has DEMISED, LEASED AND LET, and by these presents does <br /> <br />Demise, Lease and Let, unto the said party of the second part, space on the roof on party of the first <br />part's building located at 101 Second Street South (High Rise building). Said space house radio <br /> <br />and communication equipment and facilities for emergency communication providing facilities for <br />local law enforcement, public safety, and the like. Said facility shall also include the existing two- <br /> <br />way radio system. The premises are located in Fargo, Cass County, North Dakota, to wit: <br /> <br />Lot Three (3), in Block Four (4), of North Dakota Urban Renewal #2 to the City <br />of Fargo, Cass County, North Dakota, more commonly known as 101 Second <br />Street South, Fargo, North Dakota. <br /> <br />TO HAVE AND TO HOLD, The above-rented premises to the said party of the second <br /> <br />party, its successors and assigns, for and during the full term of thirty (30) years from and after the <br /> <br />date hereof unless terminated by the parties pursuant to the terms of a Joint Powers Agreement <br /> <br />between the parties. The term of this lease shall commence thirty (30) days from the date of <br /> <br />execution of this lease. <br /> <br />And the said party of the second part, for its successors and assigns, agrees to and with the <br />said party of the first part, to pay its successors or assigns, as rent for the above-described premises, <br /> <br />a total sum of Eighty-seven Thousand Dollar ($87,000.00) payable as follows: $86,971.00 for the <br />first year's rent; $1.00 per year for each of the 29 years of this lease. <br />
