DAKOTA MACHINE FIRST ADDITION, Aareement relatina to Cass Countv Drain #45 <br />Attorney Daniel Twichell, Ohnstad Twichell Law Firm, was present to request board approval <br />of an agreement relating to ownership and use of property in Dakota Machine First Addition to <br />the City of West Fargo, which includes Cass County Drain #45. <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wieland seconded to authorize the <br />chairman and the county auditor to sign an agreement between <br />Southeast Cass Water Resource District, Cass County, and DMI <br />Industries, Inc. relating to Dakota Machine First Addition, which <br />includes Cass County Drain #45. On roll call vote, the motion carried <br />unanimously. <br /> <br />13. <br /> <br />.-.. <br /> <br />ROAD DEPARTMENT, Purchase of home for future 40th Avenue hiahwav imDrovements <br />Keith Berndt, County Engineer, has negotiated a price of $125,000 for the purchase of a home <br />on 40th Avenue South over the Sheyenne River, approximately one-quarter mile east of Cass <br />County Highway 17. Mr. Berndt said 40th Avenue is a very rapidly developing area and he <br />believes the home will have to be removed in the foreseeable future to accommodate highway <br />improvements and to replace a very narrow and old township bridge at this location. Since there <br />is a willing seller at this time, he is proposing that Cass County and the City of Fargo share <br />evenly in the cost of purchasing the property. The home is being rented now for $800 per month, <br />and it appears that it will continue to be rented by the same tenant. <br />MOTION, passed <br />Mr. Wieland moved and Mr. Wagner seconded to authorize the County <br />Engineer to close on the acquisition of a home on 40th Avenue South <br />in Barnes Township near the Sheyenne River in the amount of <br />$125,000, contingent upon a sharing agreement with the City of Fargo. <br />Discussion: Mr. Burdick asked about the City of Fargo's involvement <br />if they pay half of the purchase price. Mr. Berndt said he envisions <br />Cass County owning the property, since it is currently outside the city <br />limits. He expects the City of Fargo to share in the revenue from the <br />property for as long as it is rented, if they do pay half of the cost. If <br />the property were annexed into city limits, ownership could <br />conceivably be transferred at that time. At the call for the question <br />and upon roll call vote, the motion carried unanimously. <br /> <br />14. SUBDIVISION REVIEW, ADDointment of a committee <br />Mr. Wieland suggested that it is time for a review of the County Subdivision Regulations as the <br />number and size of rural subdivisions has been increasing, and this impacts roads, bridges, <br />drainage, potential flooding, etc. He suggested that the Chairman appoint a committee to begin <br />meeting in the next 30-60 days, with a recommendation back to the County Commission no later <br />than March, 2002, which would be prior to any construction that might begin in the year 2002. <br /> <br />Mr. Wagner asked about the impact on the City of Fargo since these subdivisions may be within <br />their extra-territorial zoning jurisdiction. Mr. Wieland said both Fargo and West Fargo will be <br />impacted, and he suggested that city officials and staff serve as resource people for the review. <br />- Also, he said the committee may want to seek input from local engineers and lawyers. <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Sorum seconded to appoint a county <br />subdivision review committee consisting of the following members, <br />
