Public Hearing--ApriI16, 2001 1 - PUBLIC HEARING ON U.S. FISH AND WILDLIFE LAND ACQUISITION APRIL 16, 2001--9:30 AM CASSELTON CITY HALL, CASSELTON, NORTH DAKOTA 1. CALL TO ORDER, PurDose of meetinQ John Meyer, Chairman of the Cass County Board of Commissioners, called the meeting to order with fellow Commissioners Robyn Sorum, Alon Wieland and Scott Wagner being present. Commissioner Donna Schneider was absent. Also present were Michael Montplaisir, County Auditor; Francis Klein, Tax Equalization Director; U.S. Fish and Wildlife Service Representatives Stuart Wacker, Harris Hoistad, Neil Shook and Tammy Fairbanks; Cass County Wildlife Club members David Strand, Lorne Sterner and Ken Klingenstein. Mr. Meyer said a public hearing was advertised for this date, time and place concerning the proposed acquisition of 15.08 acres by the U.S. Fish and Wildlife Service of the following land in Cass County as a waterfowl production area: Township 138 North, Range 54 West, 5th Principal Meridian Section 9, part of the S Yz and NE 1/4 described as follows: ~ All that portion of the Burlington Northern and Santa Fe Railway Company's (formerly Northern Pacific Railway Company and formerly Northern Pacific Railroad Company) Branch Line property, now discontinued, being 50 feet wide on each side of said Railway Company's Main Track centerline as originally located and constructed upon, over and across the Southeast Quarter of the Northeast Quarter, the Southeast Quarter and the East Half of the Southwest Quarter of Section 9, Township 138 North, Rand 54 West of the 5th Principal Meridian, Cass County, North Dakota, bounded on the east by the east line of said Section 9 and bounded on the west by the west line of said East Half of the Southwest Quarter of Section 9. Also, all that portion of said Railway Company's 150 foot wide Branch Line property, being 50 feet wide on the northerly side and 100 feet wide on the southerly side of said Main Track centerline in the Southwest Quarter of the Southwest Quarter of said Section 9, bounded on the east by the east line of said Southwest Quarter of the Southwest Quarter and bounded on the westerly side by the west and south lines of said Section 9. 2. PUBLIC COMMENTS The chairman invited public comments at this time. Stuart Wacker, representing the U.S. Fish and Wildlife Service, said his agency is asking the Cass County Commission to make a favorable recommendation to North Dakota Governor John Hoeven in the acquisition of this abandoned railroad right of way property. The land is bounded on both sides by an existing Waterfowl Production Area near Alice, North Dakota. ,,--.
