<br />Public Hearing--ApriI16, 2001 1 <br /> <br />- <br /> <br />PUBLIC HEARING ON U.S. FISH AND WILDLIFE LAND ACQUISITION <br />APRIL 16, 2001--9:30 AM <br />CASSELTON CITY HALL, CASSELTON, NORTH DAKOTA <br /> <br />1. <br /> <br />CALL TO ORDER, PurDose of meetinQ <br />John Meyer, Chairman of the Cass County Board of Commissioners, called the meeting to <br />order with fellow Commissioners Robyn Sorum, Alon Wieland and Scott Wagner being <br />present. Commissioner Donna Schneider was absent. Also present were Michael <br />Montplaisir, County Auditor; Francis Klein, Tax Equalization Director; U.S. Fish and Wildlife <br />Service Representatives Stuart Wacker, Harris Hoistad, Neil Shook and Tammy Fairbanks; <br />Cass County Wildlife Club members David Strand, Lorne Sterner and Ken Klingenstein. <br /> <br />Mr. Meyer said a public hearing was advertised for this date, time and place concerning the <br />proposed acquisition of 15.08 acres by the U.S. Fish and Wildlife Service of the following <br />land in Cass County as a waterfowl production area: <br /> <br />Township 138 North, Range 54 West, 5th Principal Meridian <br />Section 9, part of the S Yz and NE 1/4 described as follows: <br /> <br />~ <br /> <br />All that portion of the Burlington Northern and Santa Fe Railway Company's (formerly <br />Northern Pacific Railway Company and formerly Northern Pacific Railroad Company) <br />Branch Line property, now discontinued, being 50 feet wide on each side of said <br />Railway Company's Main Track centerline as originally located and constructed upon, <br />over and across the Southeast Quarter of the Northeast Quarter, the Southeast <br />Quarter and the East Half of the Southwest Quarter of Section 9, Township 138 North, <br />Rand 54 West of the 5th Principal Meridian, Cass County, North Dakota, bounded on <br />the east by the east line of said Section 9 and bounded on the west by the west line <br />of said East Half of the Southwest Quarter of Section 9. <br /> <br />Also, all that portion of said Railway Company's 150 foot wide Branch Line property, <br />being 50 feet wide on the northerly side and 100 feet wide on the southerly side of <br />said Main Track centerline in the Southwest Quarter of the Southwest Quarter of said <br />Section 9, bounded on the east by the east line of said Southwest Quarter of the <br />Southwest Quarter and bounded on the westerly side by the west and south lines of <br />said Section 9. <br /> <br />2. PUBLIC COMMENTS <br />The chairman invited public comments at this time. <br /> <br />Stuart Wacker, representing the U.S. Fish and Wildlife Service, said his agency is asking the <br />Cass County Commission to make a favorable recommendation to North Dakota Governor <br />John Hoeven in the acquisition of this abandoned railroad right of way property. The land is <br />bounded on both sides by an existing Waterfowl Production Area near Alice, North Dakota. <br /> <br />,,--. <br />
