CONTRACT APPROVAL, Butler Machinery: Joint Powers Aareementwith Burleiah. <br />McLean and Ward Counties: Northwestern Colleae: Burleiah County <br />,--. MOTION, passed <br />Mr. Wieland moved and Mrs. Schneider seconded to approve <br />the following contracts submitted by respective department <br />head, subject to state's attorney approval, and authorize the <br />chairman to sign: On roll call vote, the motion carried <br />unanimously. <br /> <br />Butler Machinery/Caterpillar Financial Services Corporation--Iease contract for <br />five motor graders; <br />Counties of Burleigh, McLean and Ward--Joint Powers Agreement for Electronic <br />Land Records Management; <br />Northwestern College--amendment and extension of lease for tower space <br />utilized by the Sheriffs Office for mobile radio communication equipment; <br />Burleigh County--board of prisoners at a cost of $37.00 per day. <br /> <br />~ <br /> <br />13. BUFFALO SCHOOL DEMOLITION, Bid award to Brezina Construction: deed <br />transfer of 1916 Dortion to City of Buffalo <br />Keith Berndt, County Engineer, provided Commissioners with a bid tabulation relating <br />to the Buffalo school demolition, according to the bids opened February 1, 2001, in the <br />Commission Room, Cass County Courthouse. A total of 15 bids were received, and the <br />low bidder was Brezina Construction, Fargo, in the amount of $23,950.00. Mr. <br />Brezina's bid included an additional $3,270.00 to demolish the 1916 high school, <br />however, the Buffalo Historical Society is interested in restoration and adaptive re-use <br />of the 1916 building and the adjoining property. <br /> <br />Mr. Berndt said a separate contractor removed and disposed of all asbestos at a cost <br />of $9,000. Also, an individual from the local community will allow material to be buried <br />on his farmland two miles from Buffalo, at a cost of approximately $1,000. The <br />demolition contract specifies that the cost of excavating, removing and disposing of the <br />underground fuel tanks is the responsibility of the contractor, however, Mr. Berndt said <br />Cass County will pay the expense of removing the soil under the tanks if it is determined <br />to be contaminated by fuel leaks after the contractor removes the tanks. Cass County <br />will also dispose of flourescent tubes and ballasts from the light fixtures in the building, <br />as those items should not be buried. <br /> <br />A letter was received today from E.W. (Bill) Marcks, Jr., Mayor of the City of Buffalo, <br />requesting the transfer of title to the 1916 Buffalo high school building and the adjoining <br />property to the City of Buffalo, rather than demolishing the 1916 building. The City of <br />Buffalo would then transfer the title to the Buffalo Historical Society to allow them to <br />proceed immediately in seeking funds and grants to begin their restoration plans. <br /> <br />-- <br /> <br />Birch Burdick, State's Attorney, said he contacted the Buffalo City Attorney, Brian <br />Neugebauer, suggesting some language in the proposed title transfer of the 1916 <br />building to ensure that Cass County does not again acquire title through tax forfeiture <br />if the property is later sold to a private citizen who does not pay the real estate taxes. <br />
