<br />Commission Minutes--September 18, 2000 2197 <br /> <br />plus approximately $ 4,700 for uncertified special assessments due to the installation of a sewer <br />system. <br /> <br />Mr. and Mrs. Lamb have made an offer to purchase the property for $12,000, and Mr. <br />Montplaisir said the Southeast Cass Water Resource District would be agreeable to cancelling <br />approximately $2,800 in specials not covered by the purchase price. <br /> <br />An addendum to the purchase agreement indicates, among other things, that the seller will <br />provide a warranty deed. The Board discussed conveyance of the property with the State's <br />Attorney and the timelines involved. Mr. Wieland said the county should be able to provide <br />some sort of title by the end of this week, as requested, and proceed with quiet title action at the <br />same time. Mr. Burdick said the county could give the purchaser whatever rights or title they <br />have at the moment but a warranty deed could not be given until there is a quiet title. He said <br />there are provisions in the statutes regarding counties quieting title on property acquired in tax <br />proceedings. Preparing the quiet title action is not a lengthy process, and Mr. Burdick said it <br />can be published yet this week. <br /> <br />Mr. Montplaisir suggested a quit claim deed giving the purchaser the rights to the property and <br />proceed with the quiet title. He said the purchasers have access to free fill material if they can <br />use it yet this fall, and they would build on the property in the spring. The buyer is aware that <br />a building permit must first be obtained from the Harwood City Auditor's Office, according to Mr. <br />Montplaisir. <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Schneider seconded to direct the County <br />Auditor, the State's Attorney and the County Engineer to accomplish <br />the terms of the Purchase Agreement in the most expedient manner. <br />On roll call vote, motion carried unanimously. <br /> <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Quick seconded to accept the offer of <br />$12,000 for lot 16 of lake Shure Estates, contingent upon Southeast <br />Cass Water Resource District cancelling the balance of unpaid special <br />assessments following the application of the $12,000 against the <br />uncollected taxes, certified special assessments, interest and <br />penalties, and uncertified special assessments. On roll call vote, <br />motion carried unanimously. <br /> <br />17. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Koenig moved and Mrs. Schneider seconded to approve Voucher <br />No. 144,114 through No. 144,603. On roll call vote, motion carried <br />unanimously. <br /> <br />18. JOINT DISPATCH STEERING COMMITTEE; CASS COUNTY AND WEST FARGO CITY <br />COMMISSIONERS JOINT MEETING; CHilD SUPPORT ENFORCEMENT UPDATE; WATER <br />TOPICS; MEETING UPDATES, Committee reports <br />Bonnie Johnson reported that the Joint Communications Steering Committee held their first <br />meeting last week in the Cass County Courthouse. <br />
