<br />Commission Minutes--July 3,2000 2151 <br /> <br />Everest 3% <br />Harmony 5% <br />Maple River 5% <br />Pontiac 5% <br />Rush River 5% <br /> <br />13. TAX EQUALIZATION BOARD, Adjourned for 2000 <br />With no further business to conduct and no one in the audience asking to address the board <br />on tax issues, the Chairman declared the Cass County Board of Tax Equalization adjourned <br />for the year 2000. <br /> <br />14. JAIL ELECTRICAL CONSTRUCTION, Bid bond returned to Fritz Electric <br />Stuart Boyer, President of Fritz Electric, Inc., appeared before the Board with his wife and <br />office worker, Patricia Boyer, and with his bid estimator. Mr. Boyer requested the return of <br />the bid bond which accompanied his bid for the new Cass County Jail electrical construction. <br />The bid was withdrawn by Fritz Electric because Mr. Boyer maintained an error was made <br />when the security lights were omitted from his bid. Cass County subsequently awarded the <br />electrical contract to the second low bidder, Bergstrom Electric. <br /> <br />The Chairman requested a motion for the board to go into a closed session to discuss <br />anticipated civil litigation or adversarial administrative proceedings based upon North Dakota <br />Century Code 44-04-19.1. Mr. Burdick said the purpose would be for attorney/client <br />consultation. No motion was made to go into closed discussion, and the Board openly <br />discussed the bid bond situation. <br /> <br />Commissioners Koenig, Schneider and Meyer expressed opinions in favor of returning the <br />bid bond to Fritz Electric because of financial concerns for the company. Commissioners <br />Wieland and Quick were of the opinion that this is not in the best interest of other taxpayers <br />and did not favor returning the bond. Also, they felt the law should be tested by having it <br />resolved by the courts because a bid bond appears to be of no value if it is not utilized when <br />someone withdraws their bid. <br />MOTION, passed <br />Mr. Koenig moved and Mrs. Schneider seconded to return the bid <br />bond to Fritz Electric, Inc. Motion carried on roll call vote with four <br />members voting "Aye" and Mr. Wieland opposing. <br /> <br />15. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Wieland moved and Mrs. Schneider seconded to approve <br />Voucher No. 141,515 through No. 142,231. On roll call vote, <br />motion carried unanimously. <br /> <br />16. MEETING UPDATES; CLERK OF COURT BECOMING STATE OFFICE; NORTH DAKOTA <br />ASSOCIATION OF COUNTIES BUILDING PROJECT, Committee reports <br />Commissioners reported on meetings they have attended in the past two weeks, as well as <br />upcoming meetings. <br /> <br />Mr. Wieland said discussions are continuing regarding clerk of court offices becoming a State <br />entity next spring. Some of the clerks' functions will be performed by the State, however, <br />
