TAX EQUALIZATION BOARD, Adjourned for 2000 With no further business to conduct and no one in the audience asking to address the board on tax issues, the Chairman declared the Cass County Board of Tax Equalization adjourned for the year 2000. 14. JAIL ELECTRICAL CONSTRUCTION, Bid bond returned to Fritz Electric Stuart Boyer, President of Fritz Electric, Inc., appeared before the Board with his wife and office worker, Patricia Boyer, and with his bid estimator. Mr. Boyer requested the return of the bid bond which accompanied his bid for the new Cass County Jail electrical construction. The bid was withdrawn by Fritz Electric because Mr. Boyer maintained an error was made when the security lights were omitted from his bid. Cass County subsequently awarded the electrical contract to the second low bidder, Bergstrom Electric. The Chairman requested a motion for the board to go into a closed session to discuss anticipated civil litigation or adversarial administrative proceedings based upon North Dakota Century Code 44-04-19.1. Mr. Burdick said the purpose would be for attorney/client consultation. No motion was made to go into closed discussion, and the Board openly discussed the bid bond situation. Commissioners Koenig, Schneider and Meyer expressed opinions in favor of returning the bid bond to Fritz Electric because of financial concerns for the company. Commissioners Wieland and Quick were of the opinion that this is not in the best interest of other taxpayers and did not favor returning the bond. Also, they felt the law should be tested by having it resolved by the courts because a bid bond appears to be of no value if it is not utilized when someone withdraws their bid. MOTION, passed Mr. Koenig moved and Mrs. Schneider seconded to return the bid bond to Fritz Electric, Inc. Motion carried on roll call vote with four members voting "Aye" and Mr. Wieland opposing. 15. VOUCHERS, Approved MOTION, passed Mr. Wieland moved and Mrs. Schneider seconded to approve Voucher No. 141,515 through No. 142,231. On roll call vote, motion carried unanimously. 16. MEETING UPDATES; CLERK OF COURT BECOMING STATE OFFICE; NORTH DAKOTA ASSOCIATION OF COUNTIES BUILDING PROJECT, Committee reports Commissioners reported on meetings they have attended in the past two weeks, as well as upcoming meetings. Mr. Wieland said discussions are continuing regarding clerk of court offices becoming a State entity next spring. Some of the clerks' functions will be performed by the State, however,
