<br />Commission Minutes-February 22, 2005 2865 <br /> <br />15. STATE'S ATTORNEY, Updates on pendina items <br />Mr. Vanyo placed several items on the agenda for the State's Attorney to provide an update <br />on resolving some outstanding issues, as follows: <br /> <br />Truck regulatory ordinance-Mr. Burdick said he discussed a draft truck regulatory <br />ordinance with the Sheriff and County Engineer, and he has started discussions with the <br />District Court on an agreement providing for enforcement of county ordinances. Mr. Burdick <br />suggested holding first reading of the truck regulatory ordinance at the March 21st <br />commission meeting, with the ordinance second reading being scheduled for mid-April, <br />depending upon the publication requirements between first and second reading. <br /> <br />County park ordinance-Mr. Burdick said he assigned an Assistant State's Attorney to <br />provide a draft ordinance to Commissioners Vanyo and Bennett and to the County Park <br />Board Chairman, Chad Peterson. He anticipated that an ordinance will be presented for <br />first reading in mid-March or the first meeting in April. <br /> <br />Riverbank slide legal issues-Mr. Burdick said a draft agreement has been prepared <br />concerning a slide area in the Orchard Glen Subdivision, and the County Engineer is <br />preparing a report on cost participation. This matter will be placed on the agenda for the <br />upcoming March ih commission meeting. <br /> <br />Beer and wine ordinance-Mr. Burdick said the procedure for obtaining a county license to <br />sell alcoholic beverages has not been established as an ordinance and perhaps should be <br />drafted in that manner. A county resident has expressed an interest in only selling wine, <br />which currently is included in the liquor license, and he does not wish to purchase a liquor <br />license. Mr. Burdick suggested forming a working group consisting of a member of the <br />county commission, the sheriff and state's attorney offices, and someone from the beer and <br />liquor industry to review ordinances relating to alcohol sales. He felt they could meet in the <br />next couple of weeks, and this item was scheduled for the April 4th commission meeting. <br />Mr. Bennett will represent the county commission on this group since he holds the Sheriff's <br />Department portfolio. <br /> <br />Campground at Red River Valley Fairgrounds-Mr. Burdick provided some history on the <br />campground and said there is a question about whether the county can deed the property to <br />the Fair Association, as requested by their attorney, Jonathan Garaas, who was present in <br />the audience today. Mr. Burdick said he intends to send copies of pertinent documents this <br />week to the State agency that provided grant money to the county for the campground, and <br />he will follow up with a telephone conversation to seek their advice. <br /> <br />Contract approval prior to board meetings-Mr. Burdick said contracts are submitted to him <br />at varying times and he has generally been handling those reviews himself; however, he is <br />now preparing training materials so his assistant state's attorneys can also review contracts. <br />He intends to have contracts reviewed in one week's time. <br /> <br />At will/for cause employment-Mr. Burdick said the county is an at-will employer, as noted <br />in the personnel handbook and there are some deviations to the county policies as they <br />relate to Social Services employees, who are also covered by the State Central Personnel <br />Merit System. It appears no further action is needed at this time since a bill in the State <br />Legislature relating to counties opting out of the merit system was already defeated. <br />
