RECEIVED I JAN 2 7 2005 AMENDMENT NO.2 TO , MEMORANDUM OF UNDERSTANDING , CASS COUNTY COMMISSION '~[)ð D TInS AMENDMENT is made and entered into this 3yJday of,'f;t1/JI1r/J ~4999., by and between the CITY OF FARGO, NORm DAKOTA, a municipal corporation unde~the State of North Dakota, hereinafter called "Fargo", the CITY OF WEST FARGO, NORm DAKOTA, a municipal corporation under the laws of the State of North Dakota, hereinafter called, "West Fargo", and CASS COUNTY, NORm DAKOTA, a political subdivision of the State of North Dakota, hereinafter called"Cass County", said entities also being referred to in this Agreement collectively as "governmental entities", and GROWfH INITIATIVE FUND, a North Dakota non-profit corporation, hereinafter called "GIP". Preliminary Statement Pursuant to a Memorandum of Understanding dated February 14, 1997, the governmental entities and the GIP agreed that the GIP would administer the PACE Loan Program for Fargo, West Fargo and Cas~ County. The parties desire to amend the Memorandum of Understanding to set forth the amount of funding by the governmental entities for 2000. NOW, THEREFORE, it is agreed by and between the parties as follows: 1. Section 3, Funding, is amended by adding the following thereto: (a) Each of the governmental entities agrees to contribute to the Loan Pool the following amounts for 2000: Fargo - $260,000 West Fargo - $45,000 Cass County - $400,000 The cities of Fargo and West Fargo will remit their funds to the GIF in the first quarter of 2000. Cass County will remit funds as they beco'fle available from tax collections. 2. Except as amended herein, the Memorandum of Understanding, as amended, shall remain in full force and effect.
