<br />Commission Minutes--December 20, 2004 2838 <br /> <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded to approve the Road <br />Advisory Committee's recommendation authorizing the County Engineer <br />to issue a one-time permit to Transystems, LLC to haul double trailer <br />loads on certain county roads, said permit to expire in the spring of 2005; <br />and to review the county policy on weight limits. On roll call vote, the <br />motion carried unanimously. <br /> <br />20. RESOLUTIONS #2004-16,17,18 AND 19, Condemnation for riaht of way aCQuisition <br />Another topic discussed at today's Road Advisory Committee meeting was the acquisition of <br />right-of-way for a 64th Avenue South bridge to be replaced by a box culvert. Mr. Berndt said <br />the county is in need of additional right-of-way from five property owners and only one has <br />agreed to sell at the appraised value. The Road Advisory Committee adopted a motion <br />today to accept the County Engineer's recommendation to move forward with condemnation <br />proceedings. Mr. Vanyo asked if anyone in the audience wished to speak on this issue; <br />however, no one came forward at this time. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded to adopt Resolutions <br />#2004-16, #2204-17, #2004-18 and #2004-19 to begin condemnation <br />proceedings on four 64th Avenue South properties, as recommended by <br />the Road Advisory Committee. On roll call vote, the motion carried <br />unanimously. <br /> <br />21. FOREST RIVER FLOOD LOTS, Use of county property for archery tournament <br />Clay Whittlesey, Director of Recreation for the Far~o Park District, submitted a request to <br />use county-owned flood lots in Forest River on 76t Avenue South for the purpose of hosting <br />an outdoor archery tournament June 11 and 12, 2005. He said all proper insurances, safety <br />zones and maintenance issues will be resolved and handled by the Fargo Park District and <br />the Lake Agassiz Bowmen Club. Craig Bjur, Fargo Park District Outdoor Recreation <br />Coordinator, was also present. The board informed them that some of the land in Forest <br />River belongs to Stanley Township, and Mr. Whittlesey said they would be willing to contact <br />the township board also. <br /> <br />Mr. Wagner suggested involving the county park board and to consider developing a policy <br />on the use of county-owned flood property. Mr. Pawluk said he believes this is a well <br />thought out request and deserves action today so the park district can move forward with <br />their planning process. He believes there is very little risk or exposure on the part of the <br />county for this event. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Bennett seconded that the Cass County <br />Commission grant approval to the Fargo Park District to use county <br />property in the Forest River area for an outdoor archery tournament on <br />June 11-12, 2005. Discussion: Mr. Burdick suggested this group follow <br />through with contacting Stanley Township if township-owned property <br />will be used for the archery tournament. Mrs. Johnson asked about the <br />county's recreational immunity since Mr. Whittlesey indicated a fee will <br />be charged for those attending this event. Mr. Burdick said he is not <br />sure about recreational immunity since this is a city park district event; <br />
