<br />Road Advisory Minutes--December 20,2004 <br /> <br />ROAD ADVISORY COMMITTEE <br />DECEMBER 20, 2004--1 :00 PM <br /> <br />1. MEETING TO ORDER <br />Commissioner Ken Pawluk, Highway Department Portfolio Commissioner, called a <br />meeting of the Road Advisory Committee to order at 1 :00 PM on Monday, December <br />20,2004, in the Commission Room, Cass County Courthouse. Members were present <br />as follows: Vern Bennett, Robyn Sorum, Darrell Vanyo, Scott Wagner, Ken Pawluk, <br />Keith Berndt, Dennis Rust, Jurgen Suhr and Mark Johnson. Rich Sieg was absent. <br /> <br />2. 64TH AVENUE RIGHT OF WAY ACQUISITIONS, Condemnation process to <br />proceed <br />Mr. Berndt said a box culvert project is scheduled along 64th Avenue South for next <br />year. The county needs additional right-of-way from five property owners and only one <br />has agreed to sell at the appraised value. He said the County Commission has the <br />authority to pass a resolution to condemn the properties and a condemnation board <br />would then place a value on each parcel. This process would allow the project to <br />proceed without any delay since federal dollars are involved. <br /> <br />Mr. Berndt said the largest parcel is 2.52 acres and is owned by Dalsin Company. <br />Initially, an appraisal done last year valued the piece at $73,000; however, it was thrown <br />out due to a conflict of interest with the appraiser. The second appraisal valued the <br />property at $55,000; however, the county offered to pay $63,000. Dalsin indicated they <br />will not accept less than $75,000. Mr. Berndt said the owners do not have problems <br />with the project but have issues with the values. <br /> <br />George and David Wyum were present and are representing Dalsin. The owner feels <br />the government should pay a fair price for the land. There was discussion that this <br />particular piece of land has been for sale the last few years. Mr. Wagner said the <br />county will pay the values with tax payer dollars. Mr. Vanyo suggested an appraiser be <br />hired that both the county and property owners agree upon. Mrs. Sorum said the <br />Holoiens agreed on the price for their land and they have developed property in this <br />area, so they must be comfortable with the value placed on the parcel. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Berndt seconded to accept the County <br />Engineer's recommendation to move forward with condemnation <br />proceedings. Discussion: Mr. Wagner said it appears the county <br />has attempted to find a middle ground with the Dalsin property <br />owner. Mr. Berndt said the condemnation board will place values on <br />each property and forward their recommendation to the County <br />Commission. Mr. Berndt said a bid opening for this project is slated <br />for March. On roll call vote, the motion carried unanimously. <br /> <br />3. TRUCK WEIGHT POLICIES, Trans-Svstems reauest to haul heavier loads <br />approved <br />Mr. Berndt received a request from Trans-Systems for a special permit to haul heavier <br />loads on two different county roads. They want to haul using a double trailer load. He <br />said if the committee approves the request, he suggests the county policy be revised on <br />weight limits as a precedent would be set. <br />
