<br />Commission Minutes--December 6,2004 2832 <br /> <br />MOTION, failed <br />Mr. Bennett moved to approve the purchase of a lot at the intersection of <br />64th Avenue and Cass County Highway 17 at $69,000. The chairman <br />called three times for a second to the motion and hearing none, declared <br />the motion failed. <br /> <br />Mr. Vanyo asked the State's Attorney about the process of condemning land for highway <br />improvements, and Mr. Burdick explained the process. He said there may be some <br />opportunity to go back to the real estate agent or the landowner to arrive at another figure <br />rather than condemnation. <br /> <br />Mr. Vanyo asked Mr. Berndt to attempt to meet with these people again prior to the next <br />commission meeting. If their answer is still the same, the commission will need to decide if <br />they are prepared to make a motion for condemnation or agree upon a dollar amount for <br />the land purchase. Mr. Berndt said he is currently in negotiations on the other parcels <br />needed for the project and he may need to bring all five parcels to the next board meeting. <br />Mr. Vanyo agreed the commission should look at all of them at once if sales are pending. <br /> <br />22. STATE'S ATTORNEY UPDATES, Draft truck regulatory ordinance; draft county park <br />ordinance; draft public defender contract revision <br />Commissioners were in agreement that Mr. Burdick should bring a draft truck regulatory <br />ordinance to a Road Advisory Committee meeting, which was then scheduled for December <br />20, 2004, as one of the rotational meetings that day. The Road Advisory Committee's <br />recommendation would be brought back to the county commission for a vote on the subject. <br /> <br />Concerning a draft county park ordinance, Mr. Burdick said he will have his staff set up a <br />first committee meeting before the Christmas holiday. At the November 1, 2004 <br />commission meeting, Assistant State's Attorney, Aaron Birst, said Mr. Burdick suggested <br />forming a committee to address county park issues at Brewer Lake. Today, the commission <br />again indicated agreement with the committee membership, to be as follows: County Park <br />Board Chairman, Chad Peterson, or a representative; one or more county commissioners; <br />and representatives of the state's attorney's office, highway department and sheriff's <br />department. <br /> <br />Concerning an update on the public defender contract renewal, Mr. Burdick said he will <br />prepare contract modifications and discuss it with the current public defenders. The <br />contract will be placed on the December 20th commission agenda. <br /> <br />23. PERSONNEL POLICY, Amend Section 6.30, Travel and Expense Reimbursement <br />Michael Montplaisir, County Auditor, submitted a letter dated November 12, 2004, to the <br />Personnel Overview Committee providing information on the price of gasoline, vehicle <br />purchase prices and mileage reimbursement rates in other North Dakota counties. He <br />suggested amending Cass County Personnel Policy 6.30, Travel and Expense <br />Reimbursement, to possibly follow the Federal reimbursement rate. County policy currently <br />follows State law on mileage reimbursement, which is 31 cents per mile; however, the rate <br />lags behind inflation and the increased costs of purchasing and operating a vehicle. He <br />said this would be about a 31 % increase; however, the State rate has not changed since it <br />was set by the 2001 North Dakota Legislature. <br />
