<br />Commission Minutes-October 18, 2004 <br /> <br />2810 <br /> <br />Mr. Vanyo suggested having the state's attorney explore the county's legal obligation on <br />river erosion, and Mr. Burdick said his office will research the topic and discuss it further <br />with Mr. Berndt. Mrs. Sorum asked if they could report back to the board at the next <br />meeting; and Mr. Burdick said he will plan to bring it back to the November 1st meeting. He <br />will inform the chairwoman accordingly if that deadline cannot be met. <br /> <br />Mr. Bennett asked Mr. Berndt to identify and prioritize other slide areas within the county <br />between now and the next meeting in order to determine the magnitude of the situation. A <br />determination should also be made on what responsibility a homeowner has, according to <br />Mr. Wagner, and also what problems are created for someone else by the issuance of <br />drainage permits. <br /> <br />16. ROAD DEPARTMENT, Forest River and Orchard Glen flood land <br />Mr. Berndt introduced Scott Bilben, landscape architect, who was recently hired by the <br />Greenway on the Red group to coordinate greenway projects on land along the Red River. <br />Mr. Bilben explained his recommendations regarding riparian plantings and passive walking <br />trails for some of the county owned flood property in the Forest River and Orchard Glen <br />Subdivisions. Mr. Berndt said this agenda item is for information purposes today. <br /> <br />17. TAX-FORFEITED PROPERTY, Appraisal/hearing date set <br />Michael Montplaisir, County Auditor, provided a list of real estate forfeited to Cass County <br />for delinquent taxes, pursuant to North Dakota Century Code Chapter 57-28. Alternative <br />values on the properties were provided today by Frank Klein, County Director of Tax <br />Equalization. The state's attorney's office is preparing eviction notices on the delinquent <br />properties that are occupied, and the auditor sent a letter to a delinquent property owner <br />advising him to remove personal property from a now county-owned storage condominium. <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Wagner seconded to set the minimum sales <br />price on tax-forfeited property according to the list provided by the <br />county auditor and the director of equalization; and to set the hearing <br />date on the minimum sales price as 3:30 PM on November 1, 2004. On <br />roll call vote, the motion carried unanimously. <br /> <br />18. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Meyer moved and Mr. Vanyo seconded to approve Voucher No. <br />191,477 through No. 191,929. On roll call vote, the motion carried <br />unanimously. <br /> <br />19. SOCIAL SERVICES/MERIT SYSTEM; ELECTION UPDATE; NORTH DAKOTA <br />ASSOCIATION OF COUNTIES CONVENTION; LEGISLATIONNECTOR LEVY LIMIT; <br />UPCOMING MEETINGS, Committee reports <br />Mr. Vanyo reported that he had an opportunity to attend a meeting last week where video <br />conferencing was used in a meeting with Kathy Hogan, the North Dakota Association of <br />Counties and the State Department of Human Services on State merit system changes. <br /> <br />Mr. Montplaisir reported that more people are voting by absentee ballot this year than by <br />this time in the previous presidential election. The auditor's office has been issuing 400-500 <br />absentee ballots a day, and a number of other county offices are assisting in the process. <br />
