If the slides are not repaired, they will
eventually impact the adjacent county highways.

The US Army Corps of Engineers has a program that may be able to
provide technical and financial assistance with these necessary repairs. The
program is referred to as the Emergency Bank protection program. It is part
of section 14 of the 1946 flood control act. I've included a brochure with
more information on the program for your information.

In short, the Commission would need to pass a resolution requesting the
assistance. The Corps of Engineers will evaluate the request. If the Corps
accepts the Counties request, the funding would be 75% Federal 25% local.
The program does allow the County to fund part of the local share with in-
kind work.

The City of Fargo was successful in taking advantage of this program to
repair bank failures near Trollwood Park

I am recommending we request assistance with two slide locations south of
West Fargo adjacent to Cass 17 and two locations north of Fargo adjacent to
Cass 3 1.

SUGGESTED MOTION: ADOPT RESOLUTION REQUSTING U.S.
ARMY CORPS OF ENGINEERS ASSSIST ANNCE UNDER
SECTION 14 OF THE 1946 FLOOD CONTROL ACT FOR SLIDE
REPAIRS ADJACENT TO CASS COUNTY HIGHWAYS 17 AND 31.

J:\Admin-Eng\Commission COITsp\2004 CoITespondence\Consent Memo - Corps of Engineers requestdoc
