Commission Minutes—October 6, 2014 4375 <br /> Mr. Pawluk said the proposed ordinance leaves the interpretation up to the sheriff whether <br /> the event is public or private. Mrs. Scherling believes the proposal is broad with too much <br /> left to interpretation. <br /> The board consensus was to more clearly define the ordinance, i.e. attendance numbers, <br /> and bring it back for consideration. <br /> MOTION, passed <br /> Mr. Peterson moved to table the item until the next meeting. Motion <br /> carried. <br /> 10. RESOLUTION #2014-17, Adult protective services funding <br /> Chip Ammerman, Social Services Director, said a resolution regarding statewide funding of <br /> the Adult Protective Services program was discussed at the Social Services Board meeting <br /> held earlier today. He is requesting the commission approve the resolution, which will be <br /> forwarded to North Dakota Governor Jack Dalrymple. <br /> MOTION, passed <br /> Mr. Peterson moved and Mr. Vanyo seconded to adopt Resolution <br /> #2014-17, regarding statewide funding for Adult Protective Services and <br /> related infrastructure to ensure services are provided to the vulnerable <br /> population. Motion carried. <br /> RESOLUTION #2014-17 <br /> The Cass County Social Service Board and Cass County Commission recognizes the <br /> importance of protecting the vulnerable citizens of Cass County. We urge the Governor <br /> and North Dakota Legislature to demonstrate their support by adequately funding statewide <br /> Adult Protective Services and the related infrastructure to ensure services are provided. <br /> Following the 2013 Legislative Session, Cass County informed the Department of Human <br /> Services of the intent to discontinue providing Adult Protective Services to the SE Region of <br /> North Dakota in 2015 if full funding was not provided. In July, 2014, the Cass County <br /> Commission formally provided a letter with this intent to the Department of Human Services. <br /> Dated at Fargo, North Dakota, this 6th day of October, 2014. <br /> 11. PUBLIC SALE OF USED GENERATOR, Decision to advertise for bids <br /> Michael Montplaisir, County Auditor, said he submitted a request for the commission to offer <br /> a used generator for public sale which was previously located at the Annex. He was <br /> contacted by the Buffalo Fire Department asking the county to consider donating the <br /> generator to the fire department. He asked the state's attorney to review the request under <br /> state law to see if it is allowed. <br /> Mr. Peterson said a precedent would be set if the commission approves the request, and <br /> asked how the county would decide on similar requests in the future. <br /> Mr. Burdick reviewed state law and said since the request is from a political entity, a joint <br /> powers agreement may be one possibility to legally allow the donation. Also, the <br /> commission could enact an ordinance regarding donations. <br /> The consensus of the board is to offer the generator for sale and solicit bids. <br />
