Project No. NHU-8-010(032)932 WHEREAS, the North Dakota Department of Transportation intends to proceed with the construction of the following-described street improvement: Location: W FARGO MAIN 1-94 TO SHEYENNE RIVER Type of Improvement: Grading, Surfacing, Storm Drain, Box Culvert, Lighting, Marking, City Utilities and Incidentals, Shared Use Path and Reinf. Concrete Sidewalk Point of Beginning: Sta. 1772+57.93 or RP 932.99 Point of Ending: Sta. 1855+74.55 or RP 934.57 NOW, THEREFORE, in consideration of the mutual benefits to be derived therefrom, it is agreed between the state of North Dakota, acting by and through its Director of Transportation, hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and the city of West Fargo, North Dakota, hereinafter referred to as the City, that NDDOT will construct the project in accordance with the current edition of NDDOT's Standard Specifications for Road and Bridge Construction and with the plans approved by the City, identified as project NHU-8- 010(032)932, and incorporated into this agreement by reference. 1. The City a. Will pay its percentage, as detailed in the Memorandum of Understanding (MOU) of December 22, 2008, for segment 1 of the mainline roadway, multi-use trail, service roads, landscaping, etc. This MOU is attached and incorporated by reference herein; and b. Will pay for difference in cost for concrete multi-use trail; and c. Will pay for difference in cost for new box culvert at Drain 21; and d. Will pay difference in cost for decorative lighting; and e. Will pay 100 percent of the construction cost plus will hire and pay directly the preliminary and construction engineering for all items not eligible for federal aid participation. 2.
