Memorandum of Understanding NDDOT p City of West Fargo and NDDOT ORIGINAL This Memorandum.of Understanding-(MOU)is not legally binding upon the parties,but represents an agreement in principle. It establishes the relationship between the state of North Dakota,herein after. referred to as NDDOT,whose address is 608 East Boulevard Avenue,Bismarck,ND 58505.0700,the city of West Fargo,North Dakota,hereinafter referred to as the City and the Cass County,North Dakota,here in after retkred referred to as the County,who agree that It is in the best interest of both parties to have NDDOT take the lead in the development of plans associated with the proposed Main Avenue improvements which will result from the approved. Environmental Assessment(EA)from the Federal Highway Administration. ?lease note,the proposed years for construction in this MOO will be subject to federal and state funding availability. To better identify project funding and maintenance responsibilities for Main Avenue,prior to the Cost Participation and Maintenance Agreement,we are proposing the following: I. MAINLINE SEGMENT 1—1-94 TO THE SHEYENNE RIVER NDDOT will: 1. Provide 80.93%federal funds for construction of Main'Avenuemainlirie frimr 1= 94 to the Sheyenne River. 2. Provide 9.47%State funds for construction of Main Avenue mainline from I-94 to the Sheyenne River as shown in yellow on the attached layout sheets. 3. Provide 19.07%State funds for construction of Main Avenue mainline from I-94 to 11th Street West as shown in blue on the attached layout sheets. 4. Provide construction engineering services for all federal aid funded work from I-94 Interchange to the Sheyenne River. The city of West Fargo will: 1. Provide the 10%local funds match as necessary for the use of federal aid for project work within the city limits as shown in yellow on the attached layout sheets. This total cost will include the actual construction cost plus 10%for the preliminary and construction engineering;and will pay 100%of the construction costs plus 10%for the preliminary and construction engineering of all items not eligible for federal aid participation.
