DATE: July 28, 2014 <br /> County Engineer <br /> SUBJECT: Agenda Item for August 4, 2014 Commission Meeting: To <br /> Richard S.Sieg Approve the Operations and Maintenance Agreement <br /> Superintendent between the North Cass Water Resource District and Cass <br /> County, North Dakota regarding Critical Area Treatment <br /> Thomas B.Soucy,RE. improvement projects in Section 14 of Wiser Township, <br /> Design and Construction Cass County, North Dakota <br /> Engineer <br /> The Natural Resources Conservation Service (NRCS) previously <br /> constructed a storm water drop structure as part of"critical area treatment" <br /> improvement projects in Section 14 of Wiser Township, Cass County, <br /> North Dakota. These areas are designated by NRCS as Critical Area <br /> Treatment Site 31C and was constructed nearly 20 years ago. <br /> Under this agreement the County will own, operate, maintain, and <br /> administer the Site, including all associated structure and improvements, at <br /> the County's sole cost. In return the North Cass Water Resource District <br /> will convey the right of way for this site to Cass County. The North Cass <br /> Water Resource District will also maintain annual inspection reports and <br /> provide guidance for any necessary maintenance. <br /> This project was originally constructed along the Cass County Highway 31 <br /> ditch to prevent future erosion problems. It was constructed by the NRCS <br /> with the North Cass Water Resource District serving as the sponsor. After <br /> the project was constructed, NRCS continued to maintain this site. The <br /> NRCS period of maintenance is now expiring and this structure will fall <br /> back under the sponsor, North Cass Water Resource District.
