Commission Minutes—July 7, 2014 4321 <br /> There being no additional appeals, the chairman declared the County Board of Tax <br /> Equalization adjourned for 2014. <br /> 11. HAZARD MITIGATION GRANT PROGRAM, Agreement approved with NDDES for <br /> additional flood property acquisitions <br /> Jason Benson, County Engineer, said funding was recently approved for 38 additional <br /> property acquisitions the county applied for in March through the Hazard Mitigation Grant <br /> Program (HMGP). The homes are located along the southern corridor of County Highway <br /> 81 and south of County Highway 16. The agreement with the North Dakota Department of <br /> Emergency Services is expected to arrive this week in order for the process to move <br /> forward beginning with home appraisals. He said another public meeting will be held this <br /> Wednesday evening with residents to review the acquisition process. He anticipates the <br /> county will close on properties beginning in mid-August and continue through the fall. <br /> MOTION, passed <br /> Mr. Bennett moved and Mrs. Scherling seconded to authorize the <br /> chairman to sign the agreement with the North Dakota Department of <br /> Emergency Services (NDDES) as sub-grantee for a grant through the <br /> Hazard Mitigation Grant Program (HMGP) of FEMA for additional flood <br /> property acquisitions. On roll call vote, the motion carried unanimously. <br /> 12. ROAD DEPARTMENT, Memorandum of Agreement for County Highway 25 in Oxbow <br /> Mr. Benson said the City of Oxbow recently annexed and recorded a plat for construction of <br /> a new development, new golf course holes and portions of the Oxbow/Hickson/Bakke ring <br /> levee. He provided a brief ownership history of County Highway 25 and said the north half <br /> is paved and the south half is gravel. A memorandum of agreement was drafted with the <br /> Cass County Joint Water Resource District (CCJWRD), Flood Diversion Board of Authority, <br /> Oxbow City and Oxbow Job Development for the county to transfer any interest in the south <br /> half-mile portion of County 25 and deeded right-of-way easements to allow for the new <br /> construction. <br /> State's Attorney Birch Burdick has reviewed the agreement and said when deeds are <br /> recorded, the county will want to quit claim any interest in that part of County Highway 25, <br /> including any right-of-way and easements. <br /> MOTION, passed <br /> Mr. Vanyo moved and Mr. Peterson seconded to authorize the chairman <br /> to sign the Memorandum of Agreement for Cass County Highway 25 in <br /> Oxbow with the Fargo-Moorhead Flood Diversion Authority, Cass County <br /> Joint Water Resource District, City of Oxbow, and Oxbow Job <br /> Development Authority. On roll call vote, the motion carried <br /> unanimously. <br /> 13. ROAD DEPARTMENT, 12th Avenue North reconstruction Documented Categorical <br /> Exclusion (CatEx) <br /> Mr. Benson said Metropolitan Council of Governments (MetroCOG) is in the final stages of <br /> the 12th Avenue North study and is beginning the design phase so the project may be <br /> completed in 2015. As part of the process, a Documented Categorical Exclusion (CatEx) <br /> from an Environmental Impact Statement (EIS) has been drafted to address environmental <br /> impacts. The reconstruction will incorporate a portion of 12th Avenue North from County <br /> Highway 19 east three miles to 45th Street. <br />
