Commission Minutes—June 16, 2014 4311 <br /> Mr. Bennett said the taxable valuation of property that is eligible for an exemption is <br /> $23,750. Dwight Fraedrich, owner of City View Fuel, was present. He said construction on <br /> the business was completed in 2013, and his application is for five years of payments in lieu <br /> of taxes. <br /> There was discussion about the law and how it relates to today's request. Mr. Montplaisir <br /> said state law changed last year regarding property tax incentives and is little unclear <br /> regarding PILOT projects. Renata Selzer, Assistant State's Attorney, was present for <br /> today's meeting representing State's Attorney Birch Burdick. She reviewed state law and <br /> said additional research may be needed to answer some of the questions about the <br /> process. <br /> Mark Vaux, Executive Vice President of Business Development from the Greater Fargo <br /> Moorhead Economic Development Corporation, was present. He said there are different <br /> requirements for property tax exemptions and payments in lieu of taxes. Property tax <br /> exemptions are considered before a project is constructed, while PILOTs are considered <br /> after construction has started. <br /> Mr. Pawluk believes some of the legal issues need to be reevaluated by the State's <br /> Attorney; therefore, the item was tabled until the July 7th meeting. <br /> 8. HAZARD MITIGATION GRANT PROGRAM, Lake Shure bridge construction agreement <br /> for Phase 2 <br /> Jason Benson, County Engineer, was present to discuss the Lake Shure bridge project. In <br /> 2012 the county submitted an application through the Hazard Mitigation Grant Program <br /> (HMGP) for Phase 1 project design, which has been completed. The next step is the <br /> application for Phase 2 project construction. <br /> This item was tabled at the last meeting because the necessary paperwork from the North <br /> Dakota Department of Emergency Services (NDDES) had not been received for board <br /> consideration. Mr. Benson said the county has now received approval from FEMA and <br /> NDDES for Phase 2 construction through the HMGP. Also, he said Industrial Builders <br /> submitted the low bid of $1.8 million for the construction contract. Mr. Benson said <br /> approval today will allow bridge construction and the acquisition process on the John Swartz <br /> property to proceed. He said the goal is to have the project completed prior to winter. <br /> MOTION, passed <br /> Mrs. Scherling moved and Mr. Peterson seconded to authorize the <br /> chairman to sign the agreement with the North Dakota Department of <br /> Emergency Services as sub-grantee for Phase 2 construction for a grant <br /> through the Hazard Mitigation Grant Program for the Lake Shure Bridge <br /> Project TB1206 located at 57th Street NE in Sections 16/17 of Reed <br /> Township. On roll call vote, the motion carried unanimously. <br /> MOTION, passed <br /> Mr. Vanyo moved and Mr. Peterson seconded to authorize the chairman <br /> to sign the construction contract with Industrial Builders for the Lake <br /> Shure Bridge Project TB1206 located at 57th Street NE in Sections 16/17 <br /> of Reed Township. On roll call vote, the motion carried unanimously. <br />
