<br />WHEREAS, the F-M Interpreter Coordination Work Group evaluated local needs and <br />adopted a goal of developing a model that provides coordinated training and support for a <br />decentralized network of interpreters; and, <br />WHEREAS, the partner agencies remain committed toward further coordination of <br /> <br />interpreter services; and <br />WHEREAS, pursuant to Chapter 54-40.3, N.D.c.C., and Minnesota Statutes § 471.59 (joint <br /> <br />exercise of powers), the above-named governmental units have the legal authority to enter into <br />an agreement, through action of their respective governing bodies, to jointly or cooperatively <br />exercise any power common to the contracting powers or any similar powers, including those <br /> <br />which are the same except for territorial limits within which they may be exercised; and <br />WHEREAS, the parties to this agreement believe and state that the formation of this <br /> <br />agreement is in the best interests of their respective governmental units; and <br />WHEREAS, the parties desire to enter into this agreement in order to exercise the <br />function of providing coordinated interpreter support services. <br />NOW, THEREFORE, in consideration of the mutual promIses and agreements <br />contained herein, the parties do hereby agree as follows: <br /> <br />1. <br /> <br />Establishment of Metro Area Enelish Laneuaee Interpreter Services Advisorv <br />Board. The parties will establish a joint board responsible for overseeing the work of an <br />"Interpreter Services Coordinator" to be hired by the City of Fargo on behalf of member <br />parties on a one-year contractual basis. The name of such joint board shall be the "Metro <br />Area Interpreter Coordinating Board" or such other name as is agreed upon by the <br />appointed members [hereinafter referred to as the "Coordinating Board"]. Said <br />Coordinating Board shall be comprised of at least one voting member from each entity <br />entering into this agreement and shall be appointed by the governing bodies of the <br />governmental entities entering into this joint powers agreement with membership as <br /> <br />follows: <br /> <br />A. <br /> <br />B. <br /> <br />Fargo - 1 law enforcement and 1 other representative <br />Moorhead - 1 law enforcement and 1 other representative <br />West Fargo - 1 representative <br />Cass County - 1 law enforcement and 1 other representative <br /> <br />C. <br /> <br />D. <br /> <br />Page 2 of 12 <br /> <br />Joint Powers Agreement <br />Interpreter Coordinator <br />August 2004 <br />
