Commission Minutes—January 6, 2014 4250 10. FLOOD DIVERSION MONTHLY BILLING, Approved Mr. Montplaisir discussed the billing from the FM Diversion Board of Authority for the month of December, 2013. Expenses are the county's share of engineering, legal, and construction services associated with the FM Diversion project, and half of the cost for the Minnesota share. MOTION, passed Mr. Peterson moved and Mr. Bennett seconded to approve the expenses for the Flood Diversion Board of Authority in the amount of $546,869.21 and to remit $60,763.25 for Cass County's share of cash flow to cover Minnesota receivables for the month of December, 2013. On roll call vote, the motion carried unanimously. 11. FLOOD CONTROL, State Water Commission payment to FM Diversion approved During the last three legislative sessions, the state legislature approved a total of $175 million to be spent on flood control costs. Mr. Montplaisir said this is the third request from the FM Diversion Authority. The claim in the amount of $41,490 is being made to bring the estimated figures used for reimbursement request #2 to the actual amounts paid for land acquisition associated with the Oxbow/Hickson/Bakke ring levee. MOTION, passed Mr. Bennett moved and Mr. Peterson seconded to authorize the chairman to sign the approval letter for the State Water Commission to distribute funds in the amount of $41,490 to the FM Diversion Authority pursuant to terms and conditions of Senate Bill 2020. On roll call vote, the motion carried unanimously. 12. VOUCHERS, Approved MOTION, passed Mr. Peterson moved and Mr. Bennett seconded to approve Voucher No. 275,433 through Voucher No. 275,690. On roll call vote, the motion carried unanimously. 13. PERMIT FOR RAFFLE, Approved for El Zagal Escort Motor Patrol subject to State's Attorney concurrence Birch Burdick, State's Attorney, reviewed the application for a raffle permit from El Zagal Escort Motor Patrol, and said state law outlines certain restrictions on prizes. He said the application is unclear whether the prizes fall within the rules, and once he further reviews the request, he will make sure the permit complies with the law. MOTION, passed Mr. Peterson moved and Mr. Bennett seconded to approve a raffle permit for the El Zagal Escort Motor Patrol to be held March 27, 2014, at the Hickson Community Center in Hickson, North Dakota, subject to concurrence from the State's Attorney. Motion carried. 14. RED RIVER BASIN COMMISSION CONFERENCE; FLOOD BUYOUT AUCTION; LAKE SHURE BRIDGE, Committee reports Mr. Berndt said the annual Red River Basin Commission conference will be held at the Ramada Plaza Suites and Convention Center in Fargo on January 14-16, 2014. He said an open house for the FM Flood Diversion project will be held during the conference on January 14th at 6:30 PM.
