13.8074.03000 FIRST ENGROSSMENT <br /> Sixty third with Senate Amendments <br /> Legislative Assembly ENGROSSED HOUSE BILL NO. 1120 <br /> of North Dakota <br /> Introduced by <br /> Political Subdivisions Committee <br /> (At the request of the Adjutant General) <br /> 1 A BILL for an Act to amend and reenact section 37- 17.1 -10 of the North Dakota Century Code, <br /> 2 relating to authority to issue mandatory evacuations during emergencies; and to declare an <br /> 3 emergency. <br /> 4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA: <br /> 5 SECTION 1. AMENDMENT. Section 37- 17.1 -10 of the North Dakota Century Code is <br /> 6 amended and reenacted as follows; <br /> 7 37-17.1-10. Local disasters, mandatory evacuations, or emergencies. <br /> 8 1. Unless so declared in accordance with the provisions of subsection 4 of section <br /> 9 37- 17.1 -05, a local disaster er, emergency, or mandatory evacuation order may be <br /> 10 declared only by the principal executive officer of the county or city. It may not be <br /> 11 continued or renewed for a period in excess of seven days except by or with the <br /> 12 consent of the governing board of the county or city. Any order or proclamation <br /> 13 declaring a local disaster or, emergency, or mandatory evacuation must be given <br /> 14 prompt and general publicity and must be filed promptly with the county or city auditor. <br /> 15 2. The effect of a declaration of a local disaster or emergency is to activate the response <br /> 16 and recovery aspects of any and all applicable local disaster or emergency operational <br /> 17 plans and to authorize the furnishing of aid and assistance thereunder. <br /> 18 SECTION 2.
