<br />Commission Minutes--August 2, 2004 <br /> <br />2764 <br /> <br />Mr. Wagner again expressed his concerns about jurisdictional issues and said he believes <br />municipalities should be encouraged to adopt separate ordinances, which could be similar <br />to the county ordinance. Mrs. Hermann said crossing jurisdictional lines would not be a <br />barrier for Fargo Cass Public Health because they currently provide health and <br />environmental programs through contracting with Cass County. <br />MOTION, passed <br />Mr. Meyer moved and Mr. Bennett seconded to approve first reading of <br />Ordinance #2004-- (Body Art Regulation) and its attached Cass County <br />Regulations for Owners and Operators of Body Art Establishments; and <br />to schedule the second reading and adoption for September 7,2004, <br />allowing time for publishing a summary of the ordinance in the official <br />newspaper at least 20 days between the first and second reading. On roll <br />call vote, the motion carried unanimously. <br /> <br />17. SHERIFF'S DEPARTMENT, David Habiaer vehicle impounded <br />David Habiger, Amenia, was present and said the Sheriff's Department impounded a vehicle <br />they believed was blocking the road by his property. He said the vehicle was left there <br />because it was too wet at the time for a tow truck to deliver it in his yard, and the road was <br />also too wet for anyone else to use that day. He said the vehicle had only been left there a <br />couple of hours when it was towed. Mr. Habiger requested the county to pay him $500 or <br />return the vehicle to him. Mrs. Sorum suggested that Mr. Habiger contact the Sheriff's <br />Department; and the state's attorney agreed to discuss the situation with Mr. Habiger. <br /> <br />18. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Wagner moved and Mr. Meyer seconded to approve Voucher No. <br />189,527 through No. 189,901. On roll call vote, the motion carried <br />unanimously. <br /> <br />19. ROAD DEPARTMENT UPDATE; NACO CONVENTION, Committee reports <br />Mr. Wagner asked Keith Berndt, County Highway Engineer, for a status report on his <br />military leave. Mr. Berndt said he was originally scheduled to be on the West Coast today; <br />however, he now expects to be deployed this weekend. He will continue to work until <br />receiving his orders. Mr. Wagner expressed appreciation for his work and his service in the <br />naval reserves. <br /> <br />In the interest of saving time today, Mr. Wagner said he will report at a later date on the <br />National Association of Counties conference which he and Mrs. Sorum attended in Phoenix, <br />Arizona, in mid-July, along with other local county officials. <br /> <br />20. CORRESPONDENCE, Received and filed <br />MOTION, passed <br />Mr. Wagner moved and Mr. Vanyo seconded to receive and file <br />correspondence outlined by the secretary as follows: Motion carried. <br /> <br />letter from Richard E. Jorgenson of Devils Lake regarding termination of the <br />Gateway Pistol Club's use of the Regional Law Enforcement Training Center in <br />north Fargo (Mrs. Sorum will follow-up to see if the Sheriff has responded to <br />this letter); <br />
