They feel <br />ithere is a definite need for review of the drainage situation. The Board recommended that <br />jthe group consult with the County Road Superintendent, and the Board will discuss it further <br />iwith him also. <br />! <br /> <br />Mr. Lowell Siebels again appeared regarding flood problems along County Road 32, <br />;and he feels that additional culverts should be installed between Sections 19-30 and <br />ibetween Sections 20-29, Harwood Township. The Commission feels they need to discuss this <br />Iwith the County Road Superintendent and get an overall study of these areas having <br />,drainage problems. <br /> <br />A delegation was also present regarding flooding and drainage problems along County <br />IRoad 17 in Reed Township. They stated that they contacted the County Road Superintendent, <br />'and he viewed the area with them. <br /> <br />Upon the recommendation of Roy Scheffler, County Weed Control Authority, Mrs. Stanton <br />moved and Mr. Hendrickson seconded that the County authorize the purchase of weed spraying <br />chemicals from Ostlund Chemical Company of Fargo for the 1979 spraying season. <br />Motion carried. <br /> <br />Agree. with SE Mrs. Wold moved and Mr. Hendrickson seconded that the Chairman be authorized to sign <br />Mental Health for the agreement with the Southeast Mental Health and Retardation Center for the <br />Inebriate Prgm. Public Inebriate Program in the County Jail. Supt. desig- <br />nated on flood <br />documents <br /> <br />Notice of Claim <br />referred to Co. <br />Insurance Compo <br /> <br />Vouchers apprvd. <br /> <br />States Attorney Cynthia Rothe informed the Board that Duane Breitling, Attorney <br />for the bridge law suit with the City of Fargo, recommends that if the County Commission <br />desires to make an appeal to the North Dakota Supreme Court on the decision of <br />District Court Judge John Garaas, that it be done as soon as possible. <br /> <br />Mrs. Stanton moved and Mr. Sondrall seconded that Cass County authorize <br />Attorney Duane Breitling to proceed with an appeal to the North Dakota Supreme Court <br />on Judge Garaas' opinion on the City of Fargo vs. Cass County on the bridge suit. <br />However, Mr. Hendrickson asked the Board to postpone this action for one week <br />because he understands that the City of Fargo would be willing to negotiate with the County <br />for a very favorable settlement on the bridge suit. He stated that the City of Fargo <br />is seeking Federal funds for bridge construction. Mrs. Wold felt that if there is a chance <br />to negotiate with the City of Fargo thus avoiding another Court. situation, the County <br />should delay action for one week. The motion and second-were withdrawn on the premises <br />that the City of Fargo officials appear before the County Board publicly next Wednesday <br />to discuss this. <br /> <br />Assistant States Attorney Joe TUrman met with Architect Richard Moorhead to further <br />discuss the terms of the proposed contract for architectural services and made some <br />adjustments. Upon the rec~ommendation of Mr. Turman, Mr. Hendrickson moved and Mrs. Wold <br />seconded that the Chairman~be authorized to sign the contract for architectural services <br />with Clark, Holman & Moorhead for the Courthouse office space project. Motion carried. <br /> <br />Upon the request of Sheriff Don Rudnick, Mr. Hendrickson moved and Mr. Sondrall <br />econded that the Chairman be authorized .to sign the grant application to the <br />North Dakota Law Enforcement Council for' exercise equipment for the County Jail, the <br />to the County to be $290.00. Motion carried. <br /> <br />cost <br /> <br />Mrs. Wo~d moved and Mr. Sondrall seconded that the County Sheriff's Department <br />be authorized to purchase two radar units from the State Highway Department at a cost <br />to the County of $1,167.00. Motion carried. <br /> <br />Mrs. Stanton moved and Mrs. Wold seconded that the Commissioners sign the Applicant's <br />Local Agent forms designating County Auditor Duane Hoehn and County Road Superintendent <br />Steve Grindberg as the County's agents to sign documents for flood disaster. Motion carried. <br /> <br />Mrs. Wold moved and Mrs. Stanton seconded that the letter from Attorney Robert A. Ramlo <br />enclosing notice of intent to file claim for personal injuries be received, filed and a copy <br />referred to the County's insurance company. Motion carried. <br /> <br />Mrs. Wold moved and Mrs. Stanton seconded that Vouchers No. 60,268 through <br />No. 61,004 and Revenue Sharing Voucher No. 180 be approved and ordered paid. Motion carried. <br /> <br />On motion by Mrs. Wold and seconded by Mr. Hendrickson, the meeting was adjourned. <br />
