Huhner, Sect~auy-Trensurer 7~-- <br /> <br />SUBJECT: Termination of DL-SR-RR Advisory C¢,m,nittee <br /> <br /> In 1996 and 1997 the above Advisory Committee was organized, said Committee <br />consisting ofp=prcsentatives from ten (10) CRies, seventeen (17) County Commissions, <br />and twenty (20) Water Resource Districts within the Devils Lake-Shayenno River-Red <br />River basins in North Dakota. The purpose ofth~ Committ~ was to establiah a <br />procedure to develop the most acceptable plan for flood control at Devils Lake. <br /> <br /> I have contacted Joe Belford of Devils Lake, one of the key organic,ers of the <br />Committee; Jim McLaughlin of Fargo, who was elected Chairman ofth~ Committee in <br />1997; and Lee Klapprodt of the State Water Commission regarding the status of the <br />Committee. It was agreed by all that due to the fact that: l) the Committee has been <br />inactive since 1999, 2) the purpose of the Committee has been assumed by other groups, <br />and 3) monies for admlnl.qrative costs are slowing being diminished by bank charges, <br />that the "Joint Exercise of Powers Agreement" establishing the Committee should be <br />terminated. <br /> <br /> Part IV, Item 9 of the Agreement states, "This agreement is effective until <br />terminated by a majority vote of the parties to thia agreement". This letter then becomes <br />a notification of intent to t~aminate the Agreement and unless a majority (24 members) of <br />the Committee t~aond to me (address in letterhead) in thc negative by May 1, 2002, <br />action will be taken to terminate said Agreement. No response will be considered a vote <br />to terminate. <br /> <br /> Sixteen County Commissions contributed funds ($I00.00 each) for administrative <br />costs for the Committee. Upon tvta&aation of the Agreement thc remaining funds will be <br />divided between the sixteen counties and a financial statement provided to those counties. <br /> <br />SUGGESTED MOTION: <br />Move to approve a request to support the termination of the Devils Lake-Sheyenne River-Red <br />River Advisory Committee, as requested in a memorandum from Merle L. Huhner, Secretary- <br />Treasurer of that committee, dated April 3, 2002. <br /> <br /> <br />
