Commission Minutes--June 27, 2000 2145 <br /> <br />DEPARTMENT HEADS-PLEASE POST IN A CONSPICUOUS PLACE FOR STAFF TO READ <br /> <br />SPECIAL MEETING OF CASS COUNTY BOARD OF COMMISSIONERS <br /> JUNE 27, 2000 <br /> <br />MEETING CALLED TO ORDER <br />Chairman John Meyer called the special meeting to order at 8:00 AM Tuesday, June 27, 2000, <br />with all members present as follows: Donna Schneider, Robbie Quick, Paul Koenig, Alon <br />Wieland and John Meyer. Other County staff in attendance were Birch Burdick, State's <br />Attorney; Bonnie Johnson, County Coordinator; Michael Montplaisir, County Auditor; and Joyce <br />Schepp, Administrative Secretary. Also present were Bill Cowman of Foss Associates and <br />Carson Longtine of Ulteig Engineers, Inc. <br /> <br />= <br /> <br />JAIL ELECTRICAL BID, Awarded to second Iow bidder, Bergstrom Electric, Inc. <br />Mr. Meyer said the first item on the agenda for this special meeting is to award the electrical bid <br />to the second Iow bidder, Bergstrom Electric, Inc. for the new Cass County jail facility. Mrs. <br />Johnson said the Cass County State's Attorney was notified by mail last Friday that Fritz Electric <br />was declining the contract that was sent to them by Foss Associates after the Commission <br />awarded bids for the general, mechanical, and electrical contracts at the last regular meeting <br />held June 19, 2000. <br /> <br />Mr. Cowman said in light of the fact that Fritz Electric, Inc. has requested to be relieved of their <br />contract obligation, the next course of action would be to award the jail electrical contract to the <br />second Iow bidder, Bergstrom Electric, Inc. in the amount of $3,053,000.00. This price reflects <br />the base bid plus the alternate, E-3, which is an acoustic metal deck, he said. MOTION, passed <br /> Mrs. Quick moved and Mr. Wieland seconded to award the bid for <br /> electrical construction of the new Cass County Jail, as recommended <br /> by the architect and county staff, to Bergstrom Electric, Inc. in the <br /> amount of $3,053,000, which includes the base bid and alternate E-3; <br /> in addition, that Foss Associates notify the contractor of the bid <br /> awarded today and to begin preparing the necessary contract and <br /> notice to proceed. Discussion: Mr. Burdick said he received a <br /> telephone call yesterday concerning the bid situation also, and he <br /> believes the letter does reflect Fritz Electric's position and they do not <br /> intend to sign the contract furnished by the jail architects. At some <br /> point last week, there was an indication that Fritz Electric would sign <br /> the contract, however, the State's Attorney is confident they do not <br /> intend to sign a contract for electrical work on the Cass County jail. <br /> At the call for the question and upon roll call vote, the motion carried <br /> unanimously. <br /> <br />CLOSED SESSION, Attorney consultation MOTION, passed <br /> Mr. Wieland moved and Mrs. Quick seconded that the meeting be <br /> closed at 8:20 AM in order for the board to discuss anticipated civil <br /> litigation or adversarial administrative proceedings based on North <br /> Dakota Century Code 44-04-19.1, the exception allowed for attorney <br /> <br /> <br />
