If you are not aware of the specific <br />requirements for your award, please contact your NDDOT Program Manager. <br /> <br />This contract is between the state of North Dakota, acting by and through its Director of Transportation, <br />hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, <br />North Dakota 58505-0700, and Cass County Sheriff's Department, hereinafter referred to as the <br />Contractor, whose address is PO Box 488, Fargo, North Dakota 58107-0488. <br /> <br />WHEREAS, NDDOT has been delegated the responsibility to administer the state's Annual Highway <br />Safety Plan as authorized in Section 54-07-05 of the North Dakota Century Code; and <br /> <br />WHEREAS, the Contractor requests participation in the state's Annual Highway Safety Plan; <br /> <br />THEREFORE, in consideration of the mutual promises herein set forth, NDDOT and the Contractor <br />agree: <br /> <br />I. <br /> <br />The Contractor shall perform the project(s) set forth in Appendix A, a copy of which is attached hereto <br />and made a part hereof. <br /> <br />II. <br /> <br />This contract becomes effective when all parties have signed and it shall terminate on <br />September 30, 2004. <br /> <br />III. <br /> <br />NDDOT shall reimburse the Contractor for costs incurred under the terms of this contract, not to exceed <br />$37,250. Reimbursement of all costs under this contract is contingent on federal participation. <br />Allowable costs are covered under 48 CFR Part 31. All requests for reimbursement must be submitted <br />to NDDOT within 45 days of the termination date of this contract. <br /> <br />IV. <br /> <br />The Contractor shall make all purchases and maintain and dispose of all equipment purchased in <br />accordance with 49 CFR Parts 18.32 and 18.36 or 23 CFR Part 1204, copies of which will be provided <br />upon request. <br /> <br />1 of 5 <br /> <br />DOT 16870 (Div. 09) <br />
