<br /> <br />14 <br /> <br />SECTION XII – PENALTIES <br /> <br />Any person who violates these regulations or any rule or regulation <br />adopted by the county or who violates any determination or order of <br />the county under these regulations, shall be fined not less than fifty <br />dollars ($50.00) and not more than three hundred dollars ($300.00) <br />for each violation. Each continuing day of a violation is considered a <br />separate offense. <br /> <br />SECTION XIII – VARIANCE <br /> <br />In any case where a permit is required by the Public Health Center or <br />designated officer, and upon application by the responsible person or <br />persons, the Public Health Center or designated officer finds that the <br />strict enforcement of any provision of these standards would be <br />unreasonable, impractical, or not feasible under the circumstances, <br />the Health Officer or designated officer may permit a variance. <br /> <br />In granting the variance, the Health Officer or designated officer may <br />include such conditions as is prescribed for prevention, control, or <br />abatement of pollution in harmony with the general purpose of these <br />rules and regulations and the interest of applicable local, state, or <br />federal laws. <br /> <br />In granting the variance, the Health Officer or designated officer shall <br />prepare a finding of facts which specifies the circumstances justifying <br />the granting of the variance. <br /> <br />SECTION XIV – APPEALS <br /> <br />Any person aggrieved by any order or determination of the Health <br />Officer or designated officer may within 30 days of such action <br />petition the Cass County Planning Commission for a hearing. Such <br />appeal shall be in writing and shall specify in detail the grounds for <br />the appeal. The appeal shall be filed with the County Planner <br />Auditor. <br /> <br />Within 30 days of filing, the Planning Commission shall fix a date for a <br />hearing.
