CASS COUNTY
GOVERNMENT
MEMORANDUM RECEIVED
TO: Cass County Commissioners NOV 2 5 1014
State's Attorney FROM: Birch P. Burdick 1, ,I ASS COUNTY COMMISSION
Cass County State's Attorney
Birch P.Burdick
DATE: November 25, 2014
Assistant State's RE: Ordinance Authorizing Sheriff to Police Public Events
Attorneys:
* * * * * * * * * * * * * * * * * * * * *
Mark R.Boening
Tracy J.Peters I am enclosing an updated draft of the proposed ordinance which I
Leah J.Reid eid A.Brady believe incorporates the intent of the changes moved by Commissioner
d
Kara Schmitz Olson Vanyo and approved by the Commission at your previous meeting. In
Gary E.Euren general, the changes remove all events except the new ones the Sheriff
Kimberlee J.Hegvik wishes to add, utilizes existing N.D.C.C. §53-02-08 for everything else
Cherie L.Clark and modifies the "General Provisions" paragraph. As a matter of clarity,
Tristan J.Van de Streek I explain in detail below the changes to the last draft you reviewed.
Ryan J.Younggren
Renata J.Selzer • Purpose: To this section I added a second sentence indicating
Tanya Johnson Martinez the ordinance supplements the authority within N.D.C.C. Chapter
§53-02.
• Definitions: In this section I removed references to everything
Victim/Witness except three new events (car race, car show and rodeo), I
Coordinators: maintained the definition of "vehicle" because it is used in the
description of car race and car show, and I added a definition for
Brenda Olson-Wray "person" to be consistent with N.D.C.C. §53-02-01. The
Debbie Taws i
Lori Lawson reference to "public event" is gone altogether. All the other
Lawson
events (music festival, public concert, public dance and public
dancing place) are addressed in N.D.C.C. §53-02-01.
Check Division/ • General Provisions: The Commission voted to remove the
Restitution: previously proposed ordinance language and replace it with the
language in N.D.C.C. §53-02-08, but reference the three new
Josi Schultz events. I did that in the updated draft, but I made a change to
Charlotte Eversvik that language. Here's why: N.D.C.C. §53-02-08 refers to the
sheriff "in any county". Because you are not empowered to
Box 2806 implement an ordinance in other counties, I changed the language
211 Ninth Street South to refer to Cass County.
Fargo,North Dakota 58108
For your convenience I am enclosing not only the updated draft, but the
PH:701-241-5850 existing N.D.C.C. Chapter 53-02.
Fax:701-241-5838
Cc: Paul Laney, Sheriff
Mitch Burris, Captain
