<br />RESOLUTION DETERMINING BENEFITTED PROPERTY AND <br />ASSESSING THE COST OF CONSTRUCTION AND MAINTENANCE <br />OF THE PROJECT AND FIXING A DATE FOR HEARING THEREON <br /> <br />WHEREAS, the Board of Managers of the Cass County Joint Water <br />Resource District has found, determined and declared it to be <br />necessary to construct the Sheyenne-Maple Flood Control District <br />No.3 Project; and <br /> <br />WHEREAS, the Water Resource Board has inspected any and all <br />lots, pieces or parcels of land which may be subject to assessments <br />for construction of the project. <br /> <br />NOW THEREFORE, BE IT RESOLVED, that the particular lots, <br />pieces or parcels of land, which in the opinion of the Board will <br />be especially benefitted by the construction of the project, is <br />hereby determined and a complete list of the benefits, the <br />assessment cost and the percentage assessments against each tract <br />of land benefitted by the proposed project has been made by the <br />Board of Managers and is hereby adopted and approved; and <br /> <br />BE IT FURTHER RESOLVED, that the Board has determined that a <br />levy for maintenance of the project may be levied from time to time <br />as necessary pursuant to the provisions of Section 61-16.1-45 <br />N.D.C.C.; and <br /> <br />BE IT FURTHER RESOLVED, that at least ten (10) days before the <br />hearing, the Board shall file with the Cass County Auditor, a list <br />showing the percentage assessment against each tract of land <br />benefitted by the proposed project and the approximate assessment <br />in terms of money in proportion thereto; and <br /> <br />BE IT FURTHER RESOLVED, that said assessment list and notice <br />be mailed as is required by law and that the Board does hereby fix <br />the 29th day of June, 2004, at 7:30 p.m. at the Harwood Community <br />Center, Harwood, North Dakota, as the date and place of a public <br />hearing on the proposed project. Affected land owners shall have <br />thirty (30) days after the date of hearing to file written votes in <br />support of or in opposition to the project. Said votes shall be <br />filed within the above time limit at the office of the Secretary of <br />the Cass County Joint Water Resource Board, Cass County, North <br />Dakota. <br /> <br />APPROVED: <br /> <br />Thomas L.
