<br />RECEIVED <br /> <br />JUN <br /> <br />32004 <br /> <br />GASS caul'¡ j Y i"ùMMISSION <br /> <br />INVESTIGATION OF ABATEMENT APPLICATION <br /> <br />ABATEMENT NO. 4255 <br /> <br />Following is a report on the investigation of the abatement application of: Robert & Linda <br />Lawson <br /> <br />Cass County Board of Commissioners and State Tax Commissioner: <br /> <br />The applicants are asking that the valuation be reduced on their property located at 405 8th Ave <br />NW West Fargo, ND. They're asking that the valuation be reduced from $89,200 to $78,000. It <br />would appear that they are appealing the 2004 assessment. <br /> <br />At this point, it's premature to file an abatement, as the 2004 valuation has not been finalized. <br />To appeal the current year assessment, one must first appeal to the city, county and state boards <br />of equalization. It's my understanding that the Lawson's have been in contact with the West <br />Fargo Assessor and the 2004 assessment has been lowered to $84,800. Also, the assessment has <br />been prorated to $63, 600 for 2004, as the property had been receiving an exemption. <br /> <br />The applicants can appear before the Cass County Board of Equalization, to be held June ih and <br />June 21 s1. <br /> <br />I have advised the applicants that, if aggrieved, they may re-file for abatement after the State <br />Board of Equalization finalizes the assessment this fall. <br /> <br />SUGGESTED MOTION: <br /> <br />"I move that Abatement # 4255 be denied, as it's premature to file for abatement of taxes <br />before the assessment has been finalized by the State Board of Equalization." <br /> <br />Dated this 3rd day of June, 2004. <br /> <br />if~ X~ <br /> <br />Frank Klein <br />Director of Tax Equalization <br /> <br />j:\tax\wp\abate <br />
