<br />...._-~------'"~._,~-,-".,'~_._~-- <br /> <br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />JULY 12, 1978 <br /> <br />[ Chairman Wold called the meeting to order and upon roll call, all members were <br />!present. <br /> <br />Mr. Sondrall moved and Mrs. Stanton seconded that the minutes of the previous <br />!meeting be approved as written. Motion carried. <br />I <br /> <br />Mrs. Stanton moved and Mr. Satrom seconded that the County Commission approve <br />!the Plat of Sabo Subdivision in Section 36, Barnes Township, which was approved by <br />',the County Planning Commission; and that the Chairman be authorized to sign the plat. <br />iMotion carried. <br /> <br />: Upon the request of Mr. Lowell Siebels, Mr. Satrom moved and Mr. Hendrickson <br />[seconded that the County authorize the Road Department to install a culvert for an <br />,approach to service about 80 homes along County Road 32 in Siebels' 2nd Subdivision <br />;in Harwood Township, at an estimated cost of $6,000.00 for the culvert. Motion carried. <br /> <br />Upon the recommendation of the County Road Superintendent, the following motions <br />iwere made and seconded to grant utility permits to the Northwestern Bell Telephone <br />iCompany: <br /> <br />, Mr. Satrom moved and Mr. Hendrickson seconded that a utility permit be granted <br />,to bury their line on County right of way at the Convent. Motion carried. <br /> <br />Mr. Satrom moved and Mr. Hendrickson seconded that a utility permit be granted <br />'for burying cable under old Highway 10 at West Fargo. Motion carried. <br /> <br />Mr. Satrom moved and Mrs. Stanton seconded that a utility permit be granted on <br />:old Highway 10 between Interstate 29 and the Fargo Industrial Park. Motion carried. <br /> <br />, Mrs. Stanton moved and Mr. Satrom seconded that a utility permit be granted for <br />burying cable under County Road 15 near Kindred. Motion carried. <br /> <br />Mr. Hendrickson moved and Mr. Sondrall seconded that a utility permit be <br />:granted for burying cable along and under County Road 26. Motion carried. <br /> <br />Concerning a drainage problem on the-Emerson Harris property in Reed Township <br />'due to dirt stockpiled by the Northern Improvement Company, Mr. Hendrickson moved and <br />Mrs. Stanton seconded that the States Attorney's Office contact the Northern Improvement <br />Company to correct the situation as soon as possible. Motion carried. <br /> <br />Mr. Sondrall moved and Mr. Satrom seconded that the Applications for Abatement <br />[and Settlement of TaxeS submitted by Lyle Thompson be received, filed and referred <br />'to Reed Township. Motion carried. <br /> <br />Mrs. Stanton moved and Mr. Hendrickson seconded that the following Officer's <br />Reports for June be received and filed: Motion carried. <br /> <br />Clerk of Court <br />County Court <br />Register of Deeds <br />Sheriff <br /> <br />$ 2,550.75 <br />$26,401.40 <br />$14,201. 50 <br />$ 2,823.54 <br /> <br />Attorney Jonathan Garaas appeared before the Board to present the Plat of <br />'Headland-Rutten 4th Addition in the NW>., of Section 2, Stanley Township. A lengthy <br />discussion followed, as the County Planning Commission signed the plat as having <br />reviewed it but they recommended to the Fargo City Commission that the plat be denied <br />because of the percolation tests. <br /> <br />Attorney Garaas felt that the purpose of filing a plat is to establish a legal <br />'record for selling property by lot and block descriptions rather than by metes and <br />bounds. He stated that the lots will have to conform to health codes and township <br />zoning ordinances. <br /> <br />Mr. Satrom moved and Mr. Hendrickson seconded that the County Commission sign the <br />'plat of Headland-Rutten 4th Addition. Mrs. Stanton offered a substitute motion that <br />the plat not be approved, as there was some question on the extent of the County's <br />authority over this subdivision. It was learned that only a small portion is within <br />the 2-mile extra-territorial jurisdiction of the City of Fargo, and Mr. Garaas suggested <br />that the County Commission may want to request an opinion from the States Attorney <br />if they have questions on this matter. Mrs. Stanton's motion died for lack of a second <br />Mr. Satrom's motion tostgn the plat carried on a roll call vote with Mrs. Stanton <br />opposing. <br /> <br />Upon the request of Sheriff Jack Dailey, Mr. Hendrickson moved and Mr. Sondrall <br />seconded that the Chairman be authorized to sign the contracts with the cities of Fargo, <br />West Fargo, Casselton, and Riverside for boarding prisoners at the rate of $10.00 <br />per day in the County Jail.
