Contract #53000-09-023 <br />INTERGOVERNMENTAL SERVICE CONTRACT <br />The parties to this contract are the State of North Dakota, acting through its Department of Corrections 8~ <br />Rehabilitation IDOCRI, Division of Adult Services (DAS) (STATE) and Cass Countv Jail (CONTRACTOR); <br />1. TERM OF CONTRACT <br />The term of this contract is for a period of 24 months, commencing on the 1St day of July, 2009, and terminating on <br />the 30th day of June, 2011. <br />2. SCOPE OF SERVICE <br />CONTRACTOR, in exchange for the compensation paid by STATE under this contract, agrees to provide the following <br />services: The CONTRACTOR shall undertake the custody, care, and treatment of offenders sentenced to the legal <br />and physical custody of the DOCR at the request of the DOCR in order that the DOCR be able to more effectively <br />manage its incarcerated offender population. The DOCR will not guarantee any offender population under this <br />contract. <br />1. CONTRACTOR shall provide Non-Programming Secure Correctional Housing and shall accept and <br />manage DOCR offenders, including offenders with behavior problems. <br />2. CONTRACTOR shall provide a Work Release Program that complies with applicable DOCR work release <br />policies and procedures. <br />3. CONTRACTOR shall provide Daily DOCR Offender Count to the DOCR. The daily count must indicate the <br />type of placement for each DOCR offender and must be submitted in a format designated by the DOCR. <br />a. The CONTRACTOR shall adhere to the DOCR Policy #0602 Management Information System, <br />DOCR Information Contractor Support (See Addendum A: DOCR Policy #0602). <br />b. The DOCR shall provide training to CONTRACTOR. <br />c. For the purposes of victim notification, the DOCR shall work with the CONTRACTOR to achieve <br />connectivity and populate required data fields (SAVIN compliant and utilize the DOCR'S ITAG <br />booking and discharge software). <br />3. DEFINITIONS <br />The term "offender" means individuals on parole or inmate status as defined by the DOCR. <br />4. COMPENSATION <br />STATE will pay for the services provided by CONTRACTOR under this contract an amount not to exceed $60.00 <br />per offender per day, to be paid monthly. The CONTRACTOR shall bill the DOCR for the day the offender is <br />admitted to the contract facility, but not the day of discharge from the facility. <br />The CONTRACTOR shall bill for correctional services provided on a monthly basis. The CONTRACTOR shall list <br />each DOCR offender, the status (i.e. inmate /parole violator), the specific dates of confinement for each offender, the <br />total days to be reimbursed, the agreed upon rate per day and the total amount billed (total days multiplied by the rate <br />per day) in the invoice. The CONTRACTOR shall include the full name (last, first and middle), DOB, SID, and the <br />name of the arresting or referring officer or agency. The DOCR shall submit payment within 30 days of receipt of <br />invoice. The CONTRACTOR shall submit invoice to the following for payment: DOCR Business Office, PO Box <br />5521, Bismarck, ND 58506-5521 <br />5. AUTHORITY <br />This contract is entered into under Chapters 12-44.1, 12-47, and 54-23.3 of the North Dakota Century Code. <br />Page 1 of 9 <br />
