KBERNDT282-2370 <br />STATES ATTORNEY SIGNATURE: <br />STATES ATTORNEY COMMENTS: <br />PORTFOLIO COMMISSIONER SIGNATURE: <br />NOTE: Per Cass County Subdivision Ordinance #2006-1, developers are required to <br />sign a memorandum of understanding with the Cass County Commission agreeing that <br />as part of the County Commission approval of the plat, the developer is responsible to <br />complete all required improvements. Dan Norwood, the developer, is selling the <br />property to Westfield Industries, LTD. of Rosenort, Manitoba. Westfield Industries <br />has chosen to provide financial security for the required improvements (landscaping <br />and final grading) allowing for the plat to be recorded so they can obtain a building <br />permit from Stanley Township. Once the improvements have been completed and <br />inspected by the Cass County Highway Department the financial security will be <br />released back to Westfield Industries, Ltd. <br />SUGGESTED MOTION: AUTHORIZE CHAIRMAN TO SIGN <br />CONTRACT WITH DAN NORWOOD THE DEVELOPER OF ELLINGTON <br />SUBDIVISIONS UPON THE STATE' S ATTORNEY' S APPROVAL <br />S:\Planning\Subdivisions\Ellington\Contract Approval Request.doc <br />
