CASS COUNTY
GOVERNMENT
County
Administrator
Bonnie Johnson
Box 2806
211 Ninth Street South
Fargo, North Dakota 58108
701-241.5720
Fax:701-297.6020
www.casscountynd.gov
MEMO
TO: Cass County Commissioners
FROM: Bonnie Johnson
County Administrator
DATE: May 26, 2009
SUBJECT: Genetic Information Non-Discrimination Act of 2008 (GINA)
On March 2, 2009, the Equal Employment Opportunity Commission (EEOC)
officially released proposed regulations under GINA 2008. The proposed
regulations are designed to implement the legal requirements underTitle II of
GINA, which bans the use of genetic information in the employment context.
Under the general rule of GINA, the county may not acquire genetic
information from employees, unless the request falls under one of the six
exceptions. I do not foresee any issues with this in Cass County.
Based on the nature of our equal employment opportunity process, the
provision ("genetic information") will be added to our policy 4.20 in the
second paragraph dealing with equal opportunity. The provision becomes
effective on November 21, 2009.
SUGGESTED MOTION:
Move to amend Personnel Policy 4.20 Recruiting, Screening and Hiring.
K:\HEATH ER\MEMO-BJ.doc
