ASSURANCES FOR FEDERAL PASS THROUGH FUNDS <br />17. Audit: The Subgrantee is responsible for obtaining audits in accordance with OMB Circular A-133, <br />"Audits for States, Local Governments, and Non-Profit Organizations". Subgrantees that expend <br />$500,000 or more in Federal awards in a fiscal year are required to have an audit performed. As <br />per the provisions of the Single Audit Amendments of 1996 (P. L. 104-156), the Subgrantee will <br />submit a copy of the A133 audit to the Department of Emergency Services upon its completion <br />"when the schedule of findings and questioned costs disclosed audit findings relating to Federal <br />Awards provided by the Department of Emergency Services or the summary schedule of prior <br />audit findings reported the status of any audit findings related to Federal awards that the <br />Department of Emergency Services provided." <br />If there are no findings or questioned costs that related to Federal awards provided by the <br />Department of Emergency Services pursuant to the paragraph above, the Subgrantee will provide <br />written notification to the Department of Emergency Services that: "an audit of the Subgrantee <br />was conducted in accordance with OMB Circular A133 (including the period covered by the audit <br />and the name, amount, and CFDA number of the Federal award(s) provided by the Department <br />of Emergency Services; the schedule of findings and questioned costs disclosed no audit findings <br />relating to the Federal award(s) that the Department of Emergency Services provided; and, the <br />summary schedule of prior audit findings did not report on the status of any audit findings relating <br />to the Federal award(s) that the Department of Emergency Services provided." <br />Organizations receiving less than $500,000 must have records available for review upon request <br />of the Department of Emergency Services or Federal agency. <br />18. Cash Management/Allowable Costs: The Subgrantee shall maintain accounting and project <br />records that are sufficient to prepare required reports, track funds to level of expenditure, provide <br />internal control by progress, provide budget control, assure allowable costs per A-87 Cost <br />Principles for State/Local Government or A-21 Cost Principles for Educational Institutions and the <br />Common Rules for Uniform Administrative Requirements for Grants and Cooperative <br />Agreements, provide source documentation, and assure proper cash management. Such <br />records shall be made available to the North Dakota Department of Emergency Services and the <br />federal government for inspection and audit during the contract term and for three years after the <br />date of final payment, unless any litigation, claim, or audit is started before the expiration of three <br />years, then the records shalt be retained until such action is satisfied. <br />19. Civil Rights: The Subgrantee shall comply with Title VI of the Civil Rights Acts of 1964, Executive <br />Order 11246 and Executive Order 11375. In accordance with the aforementioned act, no person <br />shall, on the grounds of race, color, national origin, age, handicap, sex, or religion be excluded <br />from participation in or be subjected to discrimination in any program or activity funded, in whole <br />or in part, by federal funds. <br />20. Debarment, Suspension: The Subgrantee is advised that the signature on the Notice of Grant <br />Award form certifies that the Subgrantee or any person associated therewith is not currently under <br />suspension, debarment, voluntary exclusion, or determination of ineligibility by any federal <br />agency; has not been suspended, debarred, voluntary excluded, or determined ineligible by any <br />federal agency within the past three years; and has not been indicted, convicted, or had a civil <br />judgment rendered against it by a court of competentjurisdiction on any matter involving fraud or <br />official misconduct within the past three years. <br />21. Drug Free: The Subgrantee certifies in accordance with C.F.R. 45 Part 76 that it will provide a <br />drug-free workplace, or in case of an individual, certify that his or her conduct of grant activity will <br />be drug-free. <br />22. Equipment: The Subgrantee agrees that equipment purchased with federal funds will be utilized <br />for the purposes intended under this grant's Scope of Services. <br />Last Updated 02-25-2008 <br />
