CASS COUNTY GOVERNMENT MEMO TO: Cass County Commissioners County FROM: Bonnie Johnson Administrator DATE: March 30, 2009 Bonnie Johnson SUBJECT: Family Medical Leave Act For the first time, in nearly a decade, changes have been made to the Family Medical Leave Act (FMLA) by the federal government. The changes were effective the first of January 2009, however, implementing regulations were received later, and now Cass County has had the opportunity to develop the new forms for requested leave. Three different forms have now been developed as follows: Family and Medical Leave Act (N) Family and Medical Leave Act (E) Family and Medical Leave Act (F) Form "N" means "Notice". This is the routine notice used by every department head to begin the FMLA process. Our existing form in the policy manual will be replaced with the updated notice. Not much has changed, but the form is much longer. The data completed by the employee and department head is mostly the same. The additional length in the form comes from the fact we are now obligated to provide more "items of notice" to the employee making application for Family and Medical Leave. While these provisions were previously contained in the personnel policy manual, they now have to be stated on the form. Form "E" means "Employee". This is the follow-up form to give an employee if the department head needs further information from the employee to determine how to manage a case. Form "F" means "Family". This is the follow-up form to give to employees when they are requesting leave to care for an eligible family member.
