INTERGOVERNMENTAL SERVICE AGREEMENT (lGA) TIllS AGREEMENT is made and entered into this ~ day of ~~ ,2009, by and between Cass County Government, by and through the Cass County Sheriffs Office, State of North Dakota (hereafter "CASS") and Ransom County Government, by and through the Ransom County Sheriffs Office, State of North Dakota (hereafter "RANSOM"). WITNESSETH, that for and in consideration ofthe mutual covenants and agreements herein contained, the parties agree as follows: 1. Scope of Service: CASS shall provide a class one correction facility for the holding of prisoners, and all necessary and incidental services associated with such detention of prisoners, at the Cass County Jail (hereafter "JAIL") located at Fargo, North Dakota. 2. Payment: RANSOM shall pay CASS the rate of Eighty-Five Dollars ($85.00) per prisoner day, which rate shall apply for any day or any part of anyone 24-hour period (midnight to midnight) during which any prisoner of RANSOM shall be housed in the JAIL. Provided that CASS shall bill for the day the offender is admitted to the JAIL but not for the day of discharge unless both are the same for which Cass shall bill one prisoner day. 3. Term: The term of this Agreement shall be continuous provided, however, that it may be modified or cancelled only upon thirty (30) days written notice by either party. All changes or modifications shall be subject to the written approval of both of the parties. In any event, this agreement shall remain in full force and effect until modified or cancelled by one or both parties. Any notice provided hereunder shall be provided in writing addressed to the executive office of the party upon whom notice is made. 4. Transportation: RANSOM shall be responsible for transportation to and from the JAIL of any prisoners which RANSOM desires CASS to detain at the JAIL. Also refer to section on Medical Care. 5. Medical Care: It is expressly understood between the parties that CASS will be providing only detention ofthe said prisoners. However, routine medical care such as sick call, self care and emergency assistance by persons trained in first aid procedures only shall be provided by CASS as part of the basic daily rate. Any additional expenditure shall be the expense of RANSOM, including, without limitation, expenditures for the medical care or treatment of and for any such prisoners. RANSOM expressly agrees to assume and pay for such expenditures as shall be necessary, including, without limitation, medical care or treatment for any prisoners of
