Box 2806 <br />Fargo, NO 58108-2806 <br /> <br />Dear Commissioners: <br /> <br />RE: Souths ide Flood Control Project <br />Request for Access to Real Property <br /> <br />You are probably familiar with the Southside Flood Control Proj~ct the <br />Southeast Cass Water Resource District is currently developing along with <br />the City of Fargo. For purposes of conducting environmental reviews to <br />determine project feasibility, Southeast Cass is requesting access to your <br />property. Enclosed is a proposed "Access Agreement" to authorize <br />Southeast Cass, its officers, employees, contractors, consultants, <br />representatives, and agents, to access your property solely for the purposes <br />described below. Note Southeast Cass is still developing this project; <br />Southeast Cass' request for access is to determine project development <br />information so Southeast Cass can make decisions regarding project <br />alignments, locations of project components, and environmental <br />assessments. <br /> <br />Access Purposes: <br />Southeast Cass requires access to your property solely for the following <br />activities related to the Souths ide Flood Control Project: <br />. Visual observation and data collection for environmental assessment. <br />. Topographic field and parcel surveying to assist in project design <br />decisions. <br /> <br />These activities primarily consist of entry upon your property by foot or <br />vehicle; no vehicles will leave the appropriate driving surfaces on your <br />property. You will notice Southeast Cass specifically included safeguards in <br />the proposed "Access Agreements" to protect your property. <br /> <br />Anticipated Time Frame for Activities: <br />If you agree to grant access to your property, we expect to begin the above <br />activities in late November 2008, with the access term expiring in June of <br />2009. Before any representative enters your property, we will give you notice <br />as to a more specific time frame. <br /> <br />SUGGESTED MOTION: <br />Authorize the chairman to sign an access agreement with Southeast Cass Water Resource District to <br />conduct environmental reviews to determine project feasibility on county-owned property involved with <br />the Southside Flood Control Project. <br />
