<br />ENCLOSURE 1 <br /> <br />FARGO'S DUTIES UNDER THE <br />TECHNICAL RESCUE AND HAZARDOUS <br />SPILL CONTAINMENT AGREEMENT <br /> <br />In addition to the duties identified within the Agreement, FARGO shall, among other <br />things: <br /> <br />1. Comply with all applicable federal, state and local laws, rules and regulations <br />including, but not limited to, 29 CFR 1910.120. <br /> <br />2. Submit a detailed report to the COUNTY of its activities in response to an <br />incident and take all appropriate measure to identify to the COUNTY the <br />person(s) responsible for each incident. <br /> <br />3. The Fargo Fire Department will certify that responders are trained to the <br />hazardous materials technician level or the technical rescue technician level <br />as appropriate for the incident. <br /> <br />4. Respond to each incident requiring technical rescue or involving the <br />unauthorized release of hazardous materials, and assist local authorities by <br />taking emergency actions necessary to protect life, property and the <br />environment. These emergency actions at the scene of a hazardous <br />materials spill or technical rescue include, but are not limited to, providing <br />technical advice to the incident commander and recommending mitigation <br />actions, and taking such actions that are in keeping with the available levels <br />of training and response capability to prevent the release, mitigate the effects <br />of the release and stabilize the emergency situation. <br /> <br />K:\HEATHER\CONTRACT-FINAL DRAFT TECHNICAL RESCUE.doc <br /> <br />6 <br />
