<br />WHEREAS, Al J. Enno and Shari D. Enno, husband and wife, are the record owners of the
<br />following real property in Cass County, North Dakota, previously owned by Marlowe O. Rud and
<br />Pamela J. Rud:

<br />Lot Six (6), in Block One (1), of Ruds Addition to the City of Horace, Cass County,
<br />North Dakota, EXCEPT the West Twenty (20') Feet of Lot Six (6); and
<br />
<br />Lots Seven (7), Eight (8), and Nine (9), in Block One (1), of Ruds Addition to the
<br />City of Horace, Cass County, North Dakota.

<br />WHEREAS, Cass County, North Dakota, a North Dakota political subdivision, is the record
<br />owner of the following parcels:

<br />The West Fifteen (15') Feet of Lots One (1), Two (2), and Three (3), in Block One
<br />(1), of Ruds Addition to the City of Horace, Cass County, North Dakota;

<br />Lot Four (4), in Block One (1), ofRuds Addition to the City of Horace, Cass County,
<br />North Dakota;
<br />
<br />The West Twenty (20') Feet of Lot Five (5), and Six (6), in Block One (1), of Ruds
<br />Addition to the City of Horace, Cass County, North Dakota.

<br />WHEREAS, as the successors in interest to Lots 1-9, the Releasors own and enjoy those
<br />ingress and egress rights previously conveyed to Marlowe O. Rud and Pamela J. Rud under that
<br />Easement dated January 29, 1999, and recorded in the office ofthe County Recorder in and for Cass
<br />County, North Dakota, on February 2, 1999, at 3:36 p.m., as Document No. 922946.

<br />WHEREAS, the Releasors wish to release, cancel, and terminate that Easement dated January
<br />29, 1999, and recorded in the office of the County Recorder in and for Cass County, North Dakota,
<br />on February 2,1999, at 3:36 p.m., as Document No. 922946, including any and all rights created
<br />under that Easement.
