<br />8. Access to Leased Premises. Tenant shall have the right to enter or leave the <br />Transmitter Building and the site of the Tower at all times during the term hereof. <br /> <br />9. No Warranty. In no event shall any approval by Landlord, or any right granted under <br />this Lease to Landlord to supervise and/or to approve any equipment, materials or <br />work relating to Tenant's use of the Tower, constitute any warranty by Landlord to <br />Tenant of the adequacy of the design, workmanship or quality of any equipment, <br />materials or work for Tenant's intended use, or impose any liability upon Landlord in <br />connection with the selection or performance of such work, equipment or materials. <br /> <br />10. Removal of Property. Tenant may remove any of its equipment or personal property <br />used in and in any way attached to the Tower, Transmitter Building or the Kindred <br />Property provided that Tenant shall not then be in default in the performance of the <br />covenants hereof; and provided that no such property shall be removed if such <br />removal would permanently injury or dismantle the Tower, Transmitter Building or <br />Kindred Property. The removal of any property shall be effected before the <br />expiration of the Lease Term and all damage caused to said premises by such removal <br />shall be repaired by Tenant on or before the expiration of the Lease Term. <br /> <br />11. Maintenance and Repair. Tenant shall, at Tenant's expense, keep Tenant's Equipment <br />at the Leased Premises in such good condition as not to disturb, damage, impair the <br />use of, or endanger the Tower, the Transmitter Building or any other users of the <br />Tower or their property, nor shall Tenant permit to exist any conduct or condition that <br />would cause any such disturbance, damage, impairment or endangerment. Tenant's <br />obligations with respect to the maintenance and repair of the Tower shall be as set <br />forth in this Lease, and Tenant will not be obligated to pay costs attributable to the <br />maintenance and repair of the Tower, the Transmitter Building or the Kindred <br />Property, except to the extent provided in this Lease. If Tenant fails to perform any <br />of its obligations under the terms of this Lease, Landlord may perform the necessary <br />or appropriate maintenance, repair or other obligation, and the costs reasonably <br />incurred by Landlord in connection therewith shall be payable by Tenant to Landlord <br />within ten (10) days following request by Landlord for such payment. <br /> <br />12. Other Agreements. It is understood and agreed by the Tenant that the lease granted <br />by this Agreement is non-exclusive and that Landlord shall have full right to allow <br />others to enter upon and occupy and use the Tower and its site and the Transmitter <br />Building for radio or other transmitting, or for any other purpose, without liability or <br />obligation to Tenant. Landlord is free to allow any party to lease space on the Tower <br />provided such agreement or agreements shall not interfere with Tenant's use of the <br />Tower. In connection herewith, Landlord shall be free to lease space anywhere on the <br />Kindred Property. Provided, however, Landlord shall cause any sublease entered into <br />by Landlord for use of the Tower during the term of this Lease by a subtenant who <br />does not currently have the right to use the Tower to include a provision to the effect <br />that such new tenant shall not unreasonably interfere with the use of the Tower by <br />tenants who already have rights to use the Tower as of the date of such new lease. <br /> <br />13. Hold Harmless and Indemnity. Tenant shall at all times indemnify and hold harmless <br />Landlord from and against any and all claims, damages, liabilities, costs and <br />expenses, including reasonable counsel fees arising out of Tenant's use of the Leased <br /> <br />4 <br />
